These Terms of Use and End User License Agreement (“Terms” or “EULA”) are a legal agreement between you and Qi Bingbing (“Developer,” “we,” “us,” or “our”) governing your download, installation, access to, and use of Y2K Camera (“Y2K Camera” or the “App”).

By downloading, installing, purchasing, or using the App, you agree to these Terms. If you do not agree, do not download or use the App.

ACKNOWLEDGEMENT

These Terms are concluded between you and the Developer, not with Apple Inc. (“Apple”).

The Developer, not Apple, is solely responsible for the App and its content, except as otherwise required by applicable law.

Apple is not responsible for providing maintenance or support services for the App.

If these Terms conflict with the Apple Media Services Terms and Conditions or other applicable Apple usage rules, the applicable Apple terms and rules will control to the extent of that conflict.

ELIGIBILITY

You must be legally capable of entering into a binding agreement in your country or region.

If you have not reached the age of legal majority, you may use the App only with the permission and supervision of a parent or legal guardian who agrees to these Terms.

You may not use the App if applicable law prohibits you from doing so.

LICENSE GRANT

Subject to your compliance with these Terms, the Developer grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use the App on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and applicable Apple usage rules.

The App may also be accessed by other accounts associated with you through Family Sharing, volume purchasing, or other Apple features only where permitted by Apple’s applicable usage rules.

The App is licensed, not sold. No ownership interest in the App is transferred to you.

LICENSE RESTRICTIONS

Except where applicable law expressly permits it, you may not:

Copy, distribute, rent, lease, lend, sell, sublicense, or commercially exploit the App.

Reverse engineer, decompile, disassemble, attempt to derive source code from, or bypass technical protections in the App.

Modify, translate, adapt, or create derivative works based on the App.

Use the App to violate intellectual property, privacy, publicity, contractual, or other rights.

Use the App to create, edit, store, or share unlawful, abusive, defamatory, fraudulent, infringing, or harmful content.

Interfere with the security, integrity, availability, or operation of the App or Apple services.

Use automated systems to abuse purchase, restoration, or entitlement mechanisms.

Remove copyright, trademark, license, or other proprietary notices.

APP FEATURES AND DEVICE PERMISSIONS

Y2K Camera provides camera, video recording, media importing, filtering, editing, timestamping, cropping, trimming, saving, project organization, and sharing features.

Some features require access to device capabilities, including the camera, microphone, Photos library, local storage, and, where a location-based stamp is used, location information.

You may grant or deny these permissions through iOS. If you deny or revoke a required permission, the relevant feature may be unavailable or may operate with reduced functionality.

You are responsible for ensuring that you have the right and permission to capture, import, edit, save, and share any photo, video, audio, location information, or other content used with the App.

USER CONTENT

“User Content” means photos, videos, audio, text, dates, place information, edits, project files, and other materials that you capture, import, create, or process with the App.

You retain ownership of your User Content.

The current version of the App processes and stores User Content primarily on your device and does not upload it to a Developer-operated media server.

You grant the App a limited technical permission to access, copy, process, render, store, and export User Content only as necessary to provide features you request.

When you choose to share User Content through the iOS sharing interface, you authorize the transfer of that content to the recipient, application, or service you select.

You are solely responsible for your User Content and for ensuring that it does not violate applicable law or the rights of any person.

FREE AND PAID FEATURES

The App may provide both free and paid features.

Certain filters, camera effects, timestamp templates, editing tools, content packs, or other features may require an in-app purchase, an active subscription, or a lifetime unlock.

The availability and presentation of paid products may vary by country, region, device, App version, and App Store configuration.

AUTO-RENEWABLE SUBSCRIPTIONS

The App may offer auto-renewable subscriptions, including products such as:

Y2K Pro Monthly, providing access for one month.

Y2K Pro Yearly, providing access for one year.

The exact subscription title, duration, price, currency, introductory offer, trial period, and included features are displayed in the App and in Apple’s purchase confirmation interface before you complete the purchase.

Payment will be charged to your Apple Account when you confirm the purchase.

Your subscription automatically renews for another subscription period unless you turn off automatic renewal at least 24 hours before the end of the current subscription period.

Your Apple Account may be charged for renewal within 24 hours before the end of the current subscription period. The renewal charge will be based on the subscription price shown by Apple for your account and storefront.

You can manage or cancel your subscription through your Apple Account subscription settings. Deleting the App does not cancel an active subscription.

Cancellation takes effect at the end of the current paid subscription period unless applicable law or Apple policy provides otherwise. You will generally retain access to subscription features until that period ends.

The Developer cannot directly cancel an Apple subscription on your behalf.

FREE TRIALS AND INTRODUCTORY OFFERS

If a free trial or introductory offer is available, its duration, eligibility requirements, and price after the offer ends will be displayed before purchase.

Unless canceled at least 24 hours before the end of the trial or introductory period, the subscription will automatically convert to a paid subscription and renew at the price displayed by Apple.

Eligibility for trials and introductory offers is determined by Apple and may be limited to new or eligible subscribers.

Any unused portion of a free trial may be forfeited when you purchase a subscription, where permitted by Apple’s rules and applicable law.

LIFETIME AND OTHER NON-CONSUMABLE PURCHASES

The App may offer a non-consumable purchase such as Y2K Pro Lifetime.

A lifetime purchase is a one-time purchase that unlocks the features identified in the App for the supported lifetime of the App, subject to these Terms, technical compatibility, and applicable law.

“Lifetime” refers to the supported lifetime of the App and does not guarantee that the App, every feature, or compatibility with every future device or operating-system version will continue indefinitely.

Non-consumable purchases may be restorable through Apple’s purchase restoration mechanisms using the Apple Account that originally completed the purchase.

PRICES, TAXES, AND PRICE CHANGES

Prices are determined by the applicable App Store storefront and may vary by country, region, currency, tax requirements, and exchange rates.

The price shown by Apple in the purchase confirmation interface is the price applicable to your transaction.

Apple may collect applicable taxes and may change displayed prices or currency conversions according to App Store policies.

If the price of an auto-renewable subscription changes, Apple will provide any notice or request any consent required by applicable law and App Store policy.

BILLING, REFUNDS, AND PURCHASE RESTORATION

All purchases are processed by Apple through the App Store. The Developer does not receive or store your full payment card details or Apple Account password.

Refund requests are handled by Apple according to Apple’s refund policies and applicable law. You may request assistance through Apple’s purchase support channels.

The App provides a Restore Purchases function for eligible subscriptions and non-consumable purchases.

Purchase restoration requires the Apple Account associated with the original purchase and may require an internet connection.

Consumable purchases, if offered in the future, may not be restorable unless otherwise stated.

Nothing in these Terms limits refund, cancellation, or consumer rights that cannot lawfully be excluded.

PRIVACY

Your use of the App is also governed by the Y2K Camera Privacy Policy:

The Privacy Policy explains how the App accesses and processes camera data, microphone audio, photos, videos, optional location information, local settings, project information, purchase status, and support communications.

INTELLECTUAL PROPERTY

The App, including its software, interface, design, graphics, icons, filters, effects, templates, documentation, trademarks, and other content supplied by the Developer, is owned by or licensed to the Developer and is protected by applicable intellectual property laws.

These Terms do not grant you ownership of the App, its branding, or Developer-provided content.

You may use output created with the App for personal or commercial purposes only to the extent that you own or have permission to use all underlying User Content and your use does not violate applicable law or third-party rights.

THIRD-PARTY SERVICES AND TERMS

The App relies on or interacts with services provided by Apple, including the App Store, StoreKit, Photos, iCloud Photos, Apple Account subscription management, and the iOS sharing interface.

Your use of those services is subject to Apple’s applicable terms and privacy policy.

If you share content with another application, website, platform, or person, the recipient’s terms and privacy practices apply.

You must comply with all applicable third-party agreement terms when using the App.

The Developer is not responsible for independent third-party services, content, availability, security, or privacy practices.

MAINTENANCE AND SUPPORT

The Developer, not Apple, is responsible for maintenance and support of the App to the extent required by applicable law.

Apple has no obligation to provide maintenance or support services for the App.

UPDATES AND CHANGES TO THE APP

The Developer may provide updates to improve performance, compatibility, security, features, or legal compliance.

Updates may modify, add, or remove features. We will not limit any non-waivable consumer rights you may have under applicable law.

Future versions may require a supported device, operating-system version, network connection, or acceptance of updated Terms.

If you do not install a required update, some features may stop working or the App may become incompatible with Apple services or your device.

AVAILABILITY

We aim to keep the App functional but do not guarantee that it will always be available, uninterrupted, error-free, or compatible with every device, media format, accessory, operating-system version, or third-party service.

App features may be affected by device hardware, available storage, permissions, network connectivity, App Store availability, Apple services, and operating-system limitations.

We may suspend or discontinue the App or a feature where reasonably necessary for security, legal compliance, technical reasons, or business reasons, subject to applicable law.

WARRANTY DISCLAIMER

To the maximum extent permitted by applicable law, the App is provided “as is” and “as available,” with all faults and without warranties of any kind.

The Developer disclaims all express, implied, and statutory warranties, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, non-infringement, availability, and compatibility.

The Developer does not warrant that:

The App will meet every requirement.

The App will operate without interruption or error.

Every effect or edit will produce a particular artistic or technical result.

Files will never be lost, corrupted, or incompatible.

The App will remain compatible with all future devices or operating systems.

You are responsible for maintaining backups of important media and project files.

Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.

If the App fails to conform to an applicable warranty, you may notify Apple. Where required by applicable Apple terms, Apple may refund the purchase price paid for the App, if any. To the maximum extent permitted by law, Apple will have no other warranty obligation regarding the App. The Developer is responsible for other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to an applicable warranty.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the Developer will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, media, business opportunities, goodwill, or use arising from or related to the App.

This limitation applies regardless of the legal theory and even if the Developer has been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, the Developer’s total liability arising from or related to the App will not exceed the greater of:

The amount you paid for the App or related in-app purchases during the twelve months before the event giving rise to the claim.

The minimum amount of liability that applicable law does not permit the Developer to exclude.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or any liability that cannot legally be excluded.

PRODUCT CLAIMS

The Developer, not Apple, is responsible for addressing claims relating to the App or your possession or use of the App, including:

Product liability claims.

Claims that the App fails to comply with applicable legal or regulatory requirements.

Claims arising under consumer protection, privacy, or similar legislation.

Claims relating to subscriptions or in-app purchases, except where Apple is responsible under its own terms or applicable law.

INTELLECTUAL PROPERTY CLAIMS

If a third party claims that the App or your possession and use of the App infringes that party’s intellectual property rights, the Developer, not Apple, will be responsible for the investigation, defense, settlement, and discharge of the claim to the extent required by these Terms and applicable law.

You must promptly notify us at skyfishltd@outlook.com if you become aware of such a claim.

LEGAL COMPLIANCE

You represent and warrant that:

You are not located in a country or region subject to a United States government embargo or designated as supporting terrorism, except where your use is lawfully authorized.

You are not listed on a United States government list of prohibited or restricted parties.

You will comply with all applicable export-control, sanctions, import, technology, privacy, intellectual property, and consumer laws.

You will not use the App for any purpose prohibited by applicable law.

TERMINATION

These Terms remain effective until terminated by you or the Developer.

You may terminate them by stopping use of the App, canceling active subscriptions through Apple where applicable, and deleting the App.

The Developer may terminate or suspend your license if you materially violate these Terms, misuse purchase mechanisms, infringe rights, create security risks, or use the App unlawfully.

Upon termination, you must stop using and delete the App. Provisions that by their nature should survive termination will remain effective, including provisions concerning ownership, payment obligations already incurred, disclaimers, limitation of liability, disputes, and third-party beneficiaries.

Termination of these Terms does not automatically cancel an Apple subscription. You must separately cancel the subscription through your Apple Account settings.

GOVERNING LAW AND DISPUTES

Except where the mandatory laws of your country or region provide otherwise, these Terms are governed by the laws applicable in the jurisdiction where the Developer is legally established, without regard to conflict-of-law principles.

Any dispute will be submitted to a court with lawful jurisdiction over the Developer, unless applicable consumer law gives you the right to bring a claim in another court or use another dispute-resolution process.

Nothing in this section limits mandatory consumer rights available in your country or region.

APPLE AS THIRD-PARTY BENEFICIARY

Apple and its subsidiaries are third-party beneficiaries of these Terms.

After you accept these Terms, Apple will have the right, and will be deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

CHANGES TO THESE TERMS

We may update these Terms to reflect changes to the App, purchases, legal requirements, or business practices.

The revised Terms will identify a new “Last Updated” date and will be published through the Terms of Use link associated with the App.

Where required by applicable law, we will provide additional notice or obtain consent before materially revised Terms take effect.

Your continued use of the App after revised Terms take effect constitutes acceptance to the extent permitted by applicable law.

SEVERABILITY

If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

NO WAIVER

Failure to enforce a provision of these Terms does not waive the right to enforce it later.

ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without the Developer’s prior written consent.

The Developer may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or transfer of the App, subject to applicable law.

ENTIRE AGREEMENT

These Terms, the Privacy Policy, the purchase information displayed in the App, and applicable Apple terms constitute the entire agreement concerning your use of Y2K Camera and replace prior agreements concerning the same subject matter.
