Terms of Use for Harmony Baby Tracker

1. Introduction
Welcome to Harmony Baby Tracker ("Application"), a mobile app developed by Harmony ("Service Provider," "we," "us," or "our"). The Application helps parents track their child’s wellness, including sleep, feeding, growth, weight, and diaper schedules, and is offered as an ad-supported service with optional premium features. By downloading, installing, or using the Application, you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not use the Application and should uninstall it immediately.
2. Eligibility
You must be at least 18 years old or the legal age of majority in your jurisdiction to use the Application. By using the Application, you represent and warrant that you meet this age requirement and are a parent or legal guardian authorized to input information about your child (e.g., age, sleep patterns, feeding schedules). The Application is designed for adult use only, and we do not knowingly allow children under 13 to create accounts or use the Application directly, in compliance with the Children’s Online Privacy Protection Act (COPPA).
3. Account
To access certain features of the Application (e.g., cloud synchronization, premium features), you may need to create an account ("Account"). You agree to:
- Provide accurate, complete, and current information when creating your Account.
- Maintain the accuracy of your Account information.
- Keep your Account login credentials confidential and not share them with others.
- Notify us immediately of any unauthorized use of your Account at contact.harmony.app@gmail.com.
You are solely responsible for all activities that occur under your Account. We reserve the right to suspend or terminate your Account if we believe you have violated these Terms or if your Account poses a security risk.
4. License and Restrictions
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial use on a device you own or control. You agree not to:
- Copy, modify, distribute, or create derivative works of the Application or any part of it.
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Application.
- Translate the Application into other languages or create derivative versions.
- Remove or alter any copyright, trademark, or other proprietary notices in the Application.
All trademarks, copyrights, and other intellectual property rights in the Application remain the property of the Service Provider.
5. Fees and Subscriptions
The Application is offered as an ad-supported service with optional premium features available via subscription ("Paid Offerings"). By subscribing to a Paid Offering, you agree to:
- Pay the applicable fees as displayed in the Application.
- Provide a valid payment method for recurring subscription charges.
Subscriptions automatically renew at the end of each subscription period unless canceled. You can cancel your subscription at any time through the Google Play Store, App Store, or by contacting us at contact.harmony.app@gmail.com. No refunds will be provided for the unused portion of the subscription period unless required by law. We reserve the right to change our fees at any time, and we will notify you of such changes in the Application or via email.
6. Third-Party Services
The Application uses third-party services to provide functionality, display ads, and improve our services. These third-party services have their own Terms of Use, which you agree to comply with when using the Application:

7. App Store Terms
The Application is available through the Google Play Store and may be available through other app stores (collectively, "App Stores"). You agree to comply with the terms and conditions of the applicable App Store when downloading or using the Application. These Terms are between you and the Service Provider, not the App Store. If you download the Application from the Apple App Store, the following additional terms apply:
- The license granted to you is limited to a non-transferable license to use the Application on an iOS device that you own or control, as permitted by the Usage Rules in the Apple App Store Terms of Service.
- Apple has no obligation to provide maintenance or support services for the Application.
- Apple is not responsible for addressing any claims related to the Application, including product liability, legal compliance, or intellectual property infringement.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
8. Internet and Device Requirements
Some features of the Application require an active internet connection (Wi-Fi or mobile data). You are responsible for maintaining your internet connection and any associated charges from your mobile network provider, including roaming charges if you use the Application outside your home region without disabling data roaming. We are not responsible if the Application does not function fully due to lack of internet access, device battery issues, or other device-related limitations.
9. User Content
You may input data into the Application, such as information about your child’s sleep, feeding, growth, weight, or diaper schedules ("User Content"). You retain ownership of your User Content. By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process this data to provide the Application’s features (e.g., tracking, recommendations). You are responsible for ensuring that your User Content does not violate any laws or third-party rights.
10. Updates and Termination
We may update the Application at any time to improve functionality, fix bugs, or comply with platform requirements. You agree to install updates to continue using the Application. We reserve the right to discontinue the Application or terminate your access to it at any time, with or without notice, for reasons including but not limited to violation of these Terms or legal compliance. Upon termination:
- Your license to use the Application will end.
- You must stop using the Application and delete it from your device.
11. No Medical Advice
The Application provides general recommendations and information about childcare—including sleep, feeding, growth, weight, and diaper changes—based on over 9 years of professional experience and research. These recommendations are intended for informational purposes only and may not reflect the individual needs, characteristics, or medical conditions of each child.
The Application is not a substitute for professional medical advice, diagnosis, or treatment. For any medical or health-related concerns, please consult a qualified healthcare provider (e.g., a licensed pediatrician).
While we aim to offer helpful and research-informed insights, you remain responsible for how you use the information provided. Harmony and its developers, affiliates, and partners are not responsible for any decisions or outcomes related to the use of the Application. To the fullest extent permitted by law, Harmony disclaims any liability for actions taken based on the content or recommendations in the Application.
12. Warranty Disclaimer
We strive to provide a reliable and high-quality experience, but the Application is provided on an "as is" and "as available" basis. To the extent permitted by law, we do not make any express or implied warranties, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
While we work to ensure that the Application is secure, stable, and error-free, we cannot guarantee that it will always function without interruptions or technical issues. Some occasional disruptions may occur due to factors beyond our control.
We appreciate your understanding and encourage you to contact us if you encounter any problems while using the Application.
13. Limitation of Liability
To the maximum extent permitted by law, the Service Provider, its affiliates, and partners will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the Application, including but not limited to loss of data, profits, goodwill, or health-related outcomes, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Application will not exceed the greater of the amount you paid us in the past 12 months or $100 USD.
14. Indemnification
You agree to indemnify, defend, and hold the Service Provider, its affiliates, and partners harmless from any claims, losses, damages, liabilities, or expenses (including attorneys’ fees) arising from your use of the Application, violation of these Terms, or infringement of any third-party rights, including any actions taken based on the Application’s recommendations.
15. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Application will be resolved exclusively in the state or federal courts located in San Francisco, California. You consent to the personal jurisdiction and venue of these courts.
16. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we will notify you through the Application or by email. Changes will be effective immediately for new users and 5 days after notification for existing users. Your continued use of the Application after this period constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Application and uninstall it.
