# Terms and Conditions — Zola Driving

**Effective date: 17 August 2026**

These Terms and Conditions ("Terms") apply to the Zola Driving mobile application

and any related services operated by Zola ("the Service Provider", "we", "us")

(collectively, the "Application").

Zola Driving is a navigation and passenger-management tool for taxi drivers

operating in South Africa. By downloading or using the Application you agree to

these Terms. Please read them carefully before use.

---

## 1. What the Application is, and what it is not

The Application is a **technology tool**. It displays your location on a map,

shows passengers who have requested transport along your route, and passes route

information to third-party navigation software.

**The Service Provider is not a transport operator, taxi service, or carrier.** We

do not provide transport, we do not employ drivers, and we do not contract with

passengers to carry them.

Accordingly:

* No employment, partnership, agency or joint-venture relationship exists between

you and the Service Provider. You operate as an independent driver.

* Any transport service you provide is a contract between you and your passenger.

The Service Provider is not a party to it.

* We do not set, collect, process or guarantee fares. Payment arrangements are

entirely between you and your passenger.

* We do not guarantee that any passengers will be available, that trips will be

profitable, or that the Application will generate income.

---

## 2. Eligibility and driver obligations

You may only use the Application if you are at least 18 years of age and legally

permitted to operate a passenger vehicle in South Africa.

By using the Application you represent and warrant, on a continuing basis, that:

* You hold a valid South African driving licence, and a valid Professional Driving

Permit (PrDP) where required for the carriage of passengers

* You hold any operating licence or permit required under the National Land

Transport Act 5 of 2009 for the transport service you provide

* The vehicle you operate is roadworthy, licensed, and covered by the insurance

  required by law

* The information you enter in the Application — including your name, phone

number, vehicle registration and vehicle make — is accurate and kept up to date

You are solely responsible for obtaining and maintaining these licences, permits

and insurances. We do not verify them, and nothing in the Application should be

taken as confirmation that you are lawfully permitted to operate.

---

## 3. Safe use while driving

**Do not interact with the Application while your vehicle is in motion.** Set your

route and select passengers before you begin driving, or while safely stopped.

Using a mobile device while driving is an offence under the National Road Traffic

Act 93 of 1996 and its regulations. You are responsible for complying with all road

traffic laws at all times.

You remain fully responsible for the safe operation of your vehicle, for your own

safety, and for the safety of your passengers and other road users, at all times

and regardless of anything shown in the Application.

---

## 4. Navigation, maps and location data

Routes, distances, estimated times and passenger positions shown in the

Application are **advisory only** and are generated from third-party map data,

including Google Maps Platform.

* Map and route data may be inaccurate, incomplete or out of date.

* A suggested route may be unsafe, impassable, closed, or unlawful for your vehicle

  or permit class.

* GPS accuracy varies and may be degraded or unavailable.

* Passenger locations are reported by passengers' own devices and may be inaccurate

  or stale.

**You must exercise your own judgement.** Always follow actual road signs, road

markings, traffic signals and road conditions in preference to anything the

Application displays. Do not follow a suggested route if doing so would be unsafe

or unlawful.

The Application requires continuous access to your device's location, including

while running in the background, in order to function. How we handle location data

is described in the Privacy Policy.

---

## 5. Licence to use the Application

Subject to your compliance with these Terms, the Service Provider grants you a

limited, non-exclusive, non-transferable, revocable licence to install and use the

Application on a mobile device for the purpose of operating as a driver.

You may not reproduce, distribute, modify, create derivative works from, reverse

engineer, decompile or disassemble the Application, or attempt to extract its

source code, except to the extent such activity is expressly permitted by

applicable law.

You may not use the Application to harass, defraud, stalk or endanger any person,

to circumvent traffic or transport law, or in any manner that interferes with its

operation or with other users' use of it.

---

## 6. Intellectual property

The Service Provider retains all intellectual property rights in the Application,

including its code, design, trademarks, service marks, trade names, logos and

branding. Nothing in these Terms grants you any right to use our trademarks, logos

or branding. You must not remove, alter or obscure any proprietary notices in or on

the Application.

---

## 7. Messages and content you submit

The Application allows you to exchange messages with passengers assigned to you,

and to save route information. You agree not to submit content that:

* Is unlawful, or infringes the rights of any person

* Is abusive, threatening, harassing, defamatory, discriminatory, or constitutes

  hate speech

* Incites violence or unlawful conduct

* Is sexually explicit or otherwise inappropriate

* Is deceptive, or impersonates another person

* Discloses another person's personal information without their consent

* Contains spam, phishing or malicious code

Messages sent through the Application are visible to the passenger you are

communicating with. Messages associated with a trip are deleted when that trip

ends.

We may remove content, restrict features, or suspend or terminate accounts that

breach these standards. Where we take such action against you, we will tell you

what action was taken and why, and you may ask us to review the decision by

emailing **veekash708@gmail.com**. We will respond within a reasonable period.

To report content or the conduct of another user, email **veekash708@gmail.com**

with enough detail for us to identify the content or account concerned. Where the

Application provides in-app reporting or blocking, you may use those features

instead.

By submitting content you grant us a non-exclusive, royalty-free licence to store,

reproduce and display that content as necessary to operate the Application. This

licence does not permit us to sell or sublicense your content independently of the

Application. You confirm you have the right to submit the content you post.

---

## 8. Availability, changes and third-party services

Some functions require an active internet connection over Wi-Fi or your mobile

network. We are not responsible if the Application does not function fully because

you lack connectivity, have exhausted your data allowance, or your device runs out

of battery.

Your mobile network operator's terms continue to apply. You are responsible for any

data charges you incur through use of the Application, including roaming charges if

you use it outside South Africa. If you are not the account holder for the device,

we assume you have the account holder's permission.

The Application relies on the following third-party services, each governed by its

own terms:

* Google Maps Platform — https://cloud.google.com/maps-platform/terms

* Google Play Services — https://policies.google.com/terms

* Supabase — https://supabase.com/terms

* Clerk — https://clerk.com/terms

* Expo — https://expo.dev/terms

We may modify, update or discontinue the Application or any of its features at any

time. You should install updates when offered; if you do not, older versions may

stop working and we may cease supporting them. The Application is currently

provided free of charge. If we introduce charges, we will tell you clearly before

they apply.

We strongly advise against rooting or jailbreaking your device. Doing so may expose

it to malware, compromise its security, and cause the Application to malfunction or

stop working.

You are responsible for the security of your device and of access to the

Application, including keeping your sign-in credentials confidential.

---

## 9. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms. Where

the breach can be remedied, we will notify you and give you 14 days from receipt of

that notice to remedy it before terminating.

We may suspend or terminate access immediately and without notice where you break

the law, drive without the required licences, permits or insurance, infringe

intellectual property rights, or act in a way that could endanger or harm

passengers, other road users, other users of the Application, or us.

You may stop using the Application at any time by uninstalling it. On termination,

your licence to use the Application ends and you must delete all copies from your

devices.

---

## 10. Limitation of liability

To the fullest extent permitted by law, the Service Provider is not liable for any

indirect, incidental, special, consequential or punitive damages, including lost

profits, lost earnings, loss of data or business interruption, even if we were

advised of the possibility of such damages.

Without limiting the above, and to the fullest extent permitted by law, we are not

liable for:

* Any motor vehicle accident, collision, injury or death

* Any traffic fine, penalty, impoundment or prosecution incurred by you

* Any act or omission of a passenger, including non-payment, damage to your

vehicle, assault, theft, or misrepresentation of identity or destination

* Any dispute between you and a passenger

* Inaccuracy, unavailability or delay in map, route, GPS or passenger location data

* Loss of income arising from Application downtime, GPS failure, connectivity loss,

  or lack of available passengers

Our total liability for any claim will not exceed the greater of (a) the amount you

have paid us for the Application in the 12 months preceding the claim, or (b) the

minimum amount required under applicable law. The Application is currently free of

charge.

Nothing in these Terms excludes or limits our liability for death or personal

injury caused by our negligence, for fraud or fraudulent misrepresentation, or for

any liability that cannot lawfully be excluded.

**Your consumer rights.** Nothing in these Terms limits any right you have under the

Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions

Act 25 of 2002, or any other South African law that cannot lawfully be excluded. Where

any provision of these Terms conflicts with such a right, that right prevails.

---

## 11. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless

the Service Provider, its officers, employees and agents against any claims,

liabilities, damages, losses and expenses, including reasonable legal fees, arising

out of your breach of these Terms, your operation of a vehicle, your provision of

transport services, or your misuse of the Application.

This indemnity does not apply to claims arising from our own negligence, our breach

of these Terms, or our violation of applicable law. Where South African consumer

protection law restricts indemnification, this clause applies only to the maximum

extent permitted.

---

## 12. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa.

Any dispute arising out of or relating to these Terms or the Application is subject

to the jurisdiction of the South African courts. Nothing in this clause limits any

right you may have to bring a claim before a forum with jurisdiction under

mandatory law, including the National Consumer Commission or a consumer court.

---

## 13. Severability and entire agreement

If any provision of these Terms is held invalid, illegal or unenforceable, it will

be modified to the minimum extent necessary to make it valid and enforceable, and

the remaining provisions remain in full force.

These Terms, together with the Privacy Policy, constitute the entire agreement

between you and the Service Provider regarding your use of the Application, and

supersede any prior agreements or understandings.

---

## 14. Changes to these Terms

We may update these Terms from time to time. Changes will be posted on this page

with a revised effective date, and continued use of the Application after that date

constitutes acceptance. Previous versions are available on request at

**veekash708@gmail.com**.
