# Terms of Use for WellWhisper

Please read these Terms of Use ("Terms") carefully before using the WellWhisper mobile application ("App") operated by WellWhisper ("we," "us," or "our").
## 1. Acceptance of Terms
By downloading, installing, or using WellWhisper, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
## 2. Description of Service
WellWhisper is a health and wellness tracking application that:
- Integrates with Apple HealthKit to display your health data
- Provides AI-powered health insights and recommendations
- Tracks your daily activity and sleep patterns
- Offers a gamified leaderboard experience
## 3. Health Disclaimer
**IMPORTANT: WellWhisper is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.**
- The App provides general wellness information only
- Information provided should NOT replace professional medical advice
- Always consult a qualified healthcare provider for medical decisions
- In case of emergency, contact emergency services immediately
- Do not disregard professional medical advice based on App information
## 4. Eligibility
You must be at least 13 years old to use WellWhisper. By using the App, you represent that you meet this age requirement.
## 5. User Accounts
- You may use the App with anonymous authentication
- You are responsible for maintaining the confidentiality of your device
- You agree to provide accurate information when creating a profile
## 6. Subscriptions and Payments
### 6.1 Premium Subscription
- WellWhisper offers optional premium features via subscription
- Subscriptions are billed through your Apple ID account
- Prices are displayed in the App and may vary by region
### 6.2 Billing and Renewal
- Subscriptions automatically renew unless cancelled
- Cancel at least 24 hours before the renewal date
- Manage subscriptions in your Apple ID settings
### 6.3 Refunds
- Refund requests must be submitted through Apple
- We do not process refunds directly
### 6.4 Apple's Standard EULA
Your use of the App is also subject to Apple's Standard End User License Agreement (EULA), available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
## 7. Acceptable Use
You agree NOT to:
- Use the App for any illegal purpose
- Attempt to reverse engineer the App
- Interfere with the App's security features
- Upload malicious content or spam
- Impersonate other users
- Manipulate leaderboard rankings fraudulently
## 8. Intellectual Property
- WellWhisper and its content are protected by copyright
- You may not copy, modify, or distribute the App
- All trademarks are property of their respective owners
## 9. Third-Party Services
The App uses third-party services including:
- Apple HealthKit
- Google Firebase
- Google Gemini AI
- RevenueCat
Each service has its own terms and privacy policies.
## 10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- Fitness for a particular purpose
- Accuracy of health data or insights
- Uninterrupted or error-free operation
## 11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid for the subscription
- We are not responsible for health decisions based on App information
## 12. Indemnification
You agree to indemnify and hold harmless WellWhisper from any claims arising from your use of the App or violation of these Terms.
## 13. Changes to Terms
We may modify these Terms at any time. Continued use after changes constitutes acceptance of the new Terms.
## 14. Termination
- We may terminate your access for violation of these Terms
- You may stop using the App at any time
- Upon termination, your right to use the App ceases
## 15. Governing Law
These Terms are governed by the laws of Turkey. Any disputes shall be resolved in the courts of Istanbul, Turkey.
## 16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in effect.
