Welcome to TUSUp. These Terms of Use govern your access to and use of the TUSUp mobile application and related services operated by Motivex Intelligence.

By downloading, accessing, or using TUSUp, you agree to be bound by these Terms of Use. If you do not agree, you should not use the application.

1. Service Description
TUSUp is a digital study platform designed to support preparation for the TUS exam. The app may include features such as mock exams, mini quizzes, flashcards, daily cases, analytics, study groups, premium memberships, and credit-based access to certain content or features.

2. Eligibility
You may use TUSUp only if you are legally permitted to use digital services under applicable law. If you are using the app on behalf of an institution or organization, you represent that you have authority to accept these terms on its behalf.

3. User Account
Certain features require signing in with supported authentication providers such as Apple Sign In or Google Sign In. You are responsible for maintaining access to your account and for activities conducted through your account.

You agree to provide accurate information and to use the app only for legitimate personal educational purposes.

4. Subscriptions and Credits
TUSUp may offer auto-renewable subscriptions and consumable or non-consumable in-app purchases such as credits.

• Payment will be charged through your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel subscriptions through your Apple account settings after purchase.
• Credits and premium benefits are subject to the rules presented in the app at the time of purchase.
• Previously purchased subscriptions may be restored using the “Restore Purchases” option available in the app, where applicable.

5. Acceptable Use
You agree not to:

• misuse the app or attempt unauthorized access,
• interfere with the app’s normal operation,
• copy, distribute, reverse engineer, or exploit app content beyond permitted personal use,
• use the app for unlawful, abusive, fraudulent, or misleading activity.

6. Educational Purpose Only
TUSUp is provided for educational and study support purposes only. Content within the app does not constitute medical advice, diagnosis, treatment guidance, or professional healthcare instruction for patient care.

Users are solely responsible for how they interpret and use educational content provided through the app.

7. Intellectual Property
All content, branding, design elements, software components, question formats, visuals, and related materials made available through TUSUp are owned by or licensed to Motivex Intelligence and are protected by applicable intellectual property laws.

You may not reproduce, modify, distribute, sell, or create derivative works from the app or its content except where explicitly permitted.

8. Availability and Changes
We may update, change, suspend, or discontinue any part of TUSUp at any time, including features, content, pricing, subscription benefits, or technical functionality.

We do not guarantee uninterrupted or error-free access at all times.

9. Termination
We reserve the right to suspend or terminate access to TUSUp if we reasonably believe that you have violated these Terms, misused the service, or engaged in conduct that may harm the app, its users, or our operations.

You may stop using the app at any time.

10. Disclaimer of Warranties
TUSUp is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We make no warranties regarding uninterrupted availability, accuracy, completeness, suitability for a particular purpose, or error-free operation.

11. Limitation of Liability
To the maximum extent permitted by law, Motivex Intelligence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, opportunity, or educational outcomes arising from the use of or inability to use TUSUp.

13. Apple Standard EULA
If you downloaded the app from the Apple App Store, you also acknowledge that usage may be subject to Apple’s standard licensed application end user terms where applicable.
