Privacy Policy for Tricksy

Effective Date: September 13, 2025

Last Updated: September 13, 2025

This Privacy Policy describes how Tricksy ("we," "us," or "our") collects, uses, discloses, and protects the personal information of its users ("you" or "your") in connection with the Tricksy mobile application and related services (collectively, the "App").

The App provides an employee and driver management platform for businesses ("Employers"). This policy applies to two primary user types:

Employees: Who use the App for attendance tracking, requesting leave and permissions, and being assigned to drivers.

Drivers: Who use the App to manage their schedules, receive pickup assignments, and navigate to employee locations.

By downloading, accessing, or using the Tricksy App, you acknowledge that you have read, understood, and agree to the practices and policies outlined in this Privacy Policy.

1. Information We Collect

We collect information to provide, improve, and secure our services.

A. Information You Provide Directly:

Account Information: Name, email address, phone number, employee ID, profile photo, and password.

Employment Information: Your designated work schedule, department, job title, and work location.

Requests and Submissions: Details related to leave requests, permission slips, and attendance clock-in/out times.

Driver-Specific Data: Vehicle information (make, model, color, license plate), driver's license details, and insurance information.

Location Data (Precise - GPS): This is a core function of our App.

For Employees: We collect your precise location primarily during clock-in/clock-out to verify you are at your designated workplace, and when you are awaiting a pickup from a driver.

For Drivers: We collect your precise, real-time location to facilitate employee pickups, provide navigation, allow Employers to track trip progress, and verify task completion.

You can enable or disable location services via your device settings. However, disabling location services will prevent core App functions from working (e.g., clocking in, being picked up, navigating to a pickup).

B. Information Collected Automatically:

Device Information: Device type, operating system, unique device identifiers, mobile network information, and IP address.

Usage Data: How you interact with the App, including features you use, time spent, and the dates and times of your activities.

Cookies and Similar Technologies: We use cookies and similar tracking technologies to track activity on our App and hold certain information to improve user experience.

C. Information from Your Employer:

Your Employer provides us with the necessary information to create and manage your account, such as your name, work email, employee ID, and work schedule.

2. How We Use Your Information

We use the information we collect for the following purposes:

To provide, operate, and maintain the Tricksy App and its services.

To authenticate your identity and allow you to access your account.

To process your attendance, leave, and permission requests.

To facilitate the pickup and transportation process by sharing necessary location data between drivers and their assigned employees.

To enable communication between Employers, employees, and drivers within the App.

To analyze App usage and trends to improve functionality, user experience, and customer service.

To send you important administrative messages, such as security alerts, and support messages.

To prevent fraud, protect the security of our App and users, and comply with legal obligations.

3. How We Share Your Information

We do not sell your personal information. We may share your information in the following limited circumstances:

With Your Employer: Your Employer is the primary recipient of your data. They have access to your attendance records, leave requests, location data during work hours (for pickups and attendance), and other information you submit through the App. Drivers' location and trip status are shared with the Employer.

Between Drivers and Employees: To facilitate a pickup, an Employee's name, pickup location, and contact information may be shared with the assigned Driver. Similarly, a Driver's name, vehicle details, and real-time location may be shared with the Employee they are assigned to pick up.

With Service Providers: We engage trusted third-party companies (e.g., cloud hosting, data analytics, customer support, mapping services like Google Maps) to perform services on our behalf. These providers are contractually obligated to handle your data confidentially and only as instructed.

For Legal Reasons: We may disclose information if required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of ourselves, our users, or the public.

Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction.

4. Data Retention

We will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy, to comply with our legal obligations, resolve disputes, and enforce our agreements. Your Employer may have its own data retention policy which dictates how long we store data on their behalf.

5. Your Rights and Choices

Depending on your location, you may have certain rights regarding your personal information, such as:

Access and Correction: You can access and update your account information directly through the App's profile settings.

Location Services: You can control our access to your precise location through your device's settings.

Deletion: You may request the deletion of your personal data by contacting your Employer or us. Note that we may be required to retain certain information for legal or legitimate business purposes.

For any requests regarding your data, please first contact your Employer, as they control your account data. You may also contact us directly at the information provided in the "Contact Us" section below.

6. Data Security

We implement appropriate technical and organizational security measures designed to protect the security of your personal information, including encryption of data in transit. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee its absolute security.

7. Children's Privacy

The Tricksy App is not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child without verification of parental consent, we take steps to remove that information.

8. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Effective Date" at the top. We will also provide an in-App notification for significant changes. You are advised to review this Privacy Policy periodically for any changes.
