Thank you for using Talk AI app. We’re continually improving and producing more innovative products to bring the best values to yours. These terms of service are applied to all products of Appex Media. Please read carefully before using our apps.
By using Appex Media products, you agree to be bound by these Terms. If you don’t agree to these Terms, do not use our apps. If you are using our products on behalf of an organization (such as your employer), you are agreeing to these Terms for that organization, and are indicating that you have the authority to bind that organization to these Terms. In that case, “you” and “your” will refer to that organization.
By downloading, installing, registering with, accessing or using the Talk AI App (Talk AI
App), these terms and conditions (Terms and Conditions) will automatically apply to you –
you should make sure therefore that you read them carefully before using the Talk AI App.
Talk AI App provides services to generate and share with other users visual content through
the use of its AI algorithm based on the texts and images inserted by you and the art styles
provided by Talk AI App (Services). This Terms and Conditions only grants you the right to
use the Talk AI App to benefit from Services within the scope defined herein. You’re not
allowed to copy, or modify the Talk AI App, any part of the Talk AI App, or our trademarks in
any way. You’re not allowed to attempt to extract the source code of the Talk AI App, and you
also should not try to translate the Talk AI App into other languages, or make derivative
versions. The Talk AI App itself, and all the trademarks, copyright, database rights and other
intellectual property rights related to it, still belong to Appex Media .
Appex.Media is committed to ensuring that the Talk AI App is as useful and efficient as possible.
For that reason, we reserve the right to make changes to the Talk AI App or to charge for its
services, at any time and for any reason. We will never charge you for the Talk AI App or its
Appex.Media Services without making it very clear to you exactly what you’re paying for.
The Talk AI App stores and processes personal data that you have provided to us, in order
to provide our Service. It’s your responsibility to keep your phone and access to the Talk AI
App secure. We therefore recommend that you do not jailbreak or root your phone, which is
the process of removing software restrictions and limitations imposed by the official operating
system of your device. It could make your phone vulnerable to malware/viruses/malicious
programs, compromise your phone’s security features and it could mean that the Talk AI App
won’t work properly or at all.
You should be aware that there are certain things that Appex.Media will not take responsibility
for. Certain functions of the Talk AI App will require the Talk AI App to have an active internet
connection. The connection can be Wi-Fi, or provided by your mobile network provider, but
Appex.Media cannot take responsibility for the Talk AI App not working at full functionality if you
don’t have access to Wi-Fi, and you don’t have any of your data allowance left.
If you’re using the Talk AI App outside of an area with Wi-Fi, you should remember that your
terms of the agreement with your mobile network provider will still apply. As a result, you may
be charged by your mobile provider for the cost of data for the duration of the connection
while accessing the Talk AI App, or other third party charges. In using the Talk AI App,
you’re accepting responsibility for any such charges, including roaming data charges if you
use the Talk AI App outside of your home territory (i.e. region or country) without turning off
data roaming. If you are not the bill payer for the device on which you’re using the Talk AI
App, please be aware that we assume that you have received permission from the bill payer
for using the Talk AI App.
Along the same lines, Appex.Media cannot always take responsibility for the way you use the
Talk AI App i.e. You need to make sure that your device stays charged – if it runs out of
battery and you can’t turn it on to avail the Appex.Media Service, Appex.Media cannot accept
responsibility.
With respect to Appex.Media ’s responsibility for your use of the Talk AI App, when you’re using
the Talk AI App, it’s important to bear in mind that although we endeavor to ensure that it is
updated and correct at all times, we do rely on third parties to provide information to us so
that we can make it available to you. Appex.Media accepts no liability for any loss, direct or
indirect, you experience as a result of relying wholly on this functionality of the Talk AI App
Auto Renewing Subscriptions:
Subscribed user has unlimited access to the app translation services including speech to text recognizing, translating, and text to speech.
Unsubscribed users can only use those services with a limited quota per day.
Payment will be charged to Google Play or iTunes Account at confirmation of purchase
Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period
Account will be charged for renewal within 24-hours prior to the end of the current period, and identify the cost of the renewal
Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user’s Account Settings after purchase
Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.
General Prohibitions
You agree not to do or attempt to do any of the following:
Probe, scan, or test the vulnerability of any Appex Media system or network or breach any security or authentication measures;
Access, tamper with, or use non-public areas of Appex Media, Appex Media’s computer systems, or the technical delivery systems of Appex Media’s providers;
Decipher, decompile, disassemble or reverse engineer any of the software used to provide Appex Media;
Interfere with, or attempt to interfere with, the access of any user, host, or network, including sending a virus, overloading, flooding, spamming, or mail-bombing Appex Media;
Access or search Appex Media or download any intellectual property from Appex Media through the use of any engine, software, tool, agent, device, or mechanism (including spiders, robots, crawlers, data mining tools, or the like) other than our publicly supported interfaces;
Plant malware or use Appex Media to distribute malware;
Send any unsolicited communications, promotions, advertisements, or spam;
Send altered, deceptive, or false source-identifying information, including “spoofing” or “phishing”;
Post or transmit anything that is fraudulent or misleading, or that infringes on others’ rights;
Impersonate or misrepresent your affiliation with any person or entity;
Violate the privacy of others;
Violate any applicable law or regulation; or
Encourage or enable any other individual to do any of the above.
Although we’re not obligated to monitor access to or use of Appex Media or your content or to review or edit any of your content or the intellectual property of other Appex Media users, we have the right to do so for the purpose of operating Appex Media, to ensure compliance with these Terms, or to comply with applicable law or other legal requirements. We reserve the right but are not obligated, to remove or disable access to any of your content, at any time and without notice, including, but not limited to, if we, at our sole discretion, consider any of your content to be objectionable or in violation of these Terms. We have the right to investigate violations of these Terms or conduct that affects Appex Media. We may also consult and cooperate with law enforcement authorities to prosecute users who violate the law.
Check your subscriptions & their billing dates
Go to your subscriptions.
On an iPhone device:
1) Open the Settings app.
2) Tap your name.
3) Tap Subscriptions.
4) Tap the subscription.
5) Tap Cancel Subscription. You might need to scroll down to find the Cancel Subscription button. If there is no Cancel button or you see an expiration message in red text, the subscription is already canceled.
Under “Subscriptions,” check the list of subscriptions for expired subscriptions or subscriptions with declined payment methods.
What happens after you cancel
When you cancel a subscription you’ll still be able to use your subscription for the time you’ve already paid.
For example, if you buy a one-year subscription on January 1 for $10 and decide to cancel your subscription on July 1:
You’ll have access to the subscription until December 31.
You won’t be charged another yearly subscription of $10 the following January 1.

User Content
You may provide, upload, transmit, create, store, use, edit or share contents such as data,
information, phrases, entries, text, question, material with or through Services (Input); and
receive content such as phrases, text, responses created, generated, returned by Services
(Output) (Input and Output are together referred to as User Content). You may only upload,
transmit, create, store, use, edit and share User Content provided that it is in accordance
with these Terms and Conditions including the Appex.Media End-User License Agreement and
any other applicable laws.
You represent and warrant that you own the Input; and have all consents, permissions,
licenses and rights necessary to provide and license the Input as set forth under these Terms
and Conditions; and that you have the legal capacity necessary to provide and license the
Input, and enter into these Terms and Conditions in the relevant jurisdiction.
From the time of uploading or transmission of Input, you grant Appex.Media non-exclusive,
irrevocable, fully-paid, royalty-free, perpetual, sub-licensable, transferrable, worldwide,
license and right to use, broadcast, reproduce, modify, make derivative works of, record,
sublicense (on multiple levels), translate, transmit or otherwise exploit, for the limited purpose
of operating or improving the existing and future products of the Appex.Media and its affiliates,
including but not limited to training Talk AI’s AI, and in all formats and mediums and with any
technology now known or hereafter developed without notice, permission, payment or any
additional compensation to you or a third party.
You are solely and strictly liable for User Content and the consequences of posting or
publishing them in any way, including for ensuring that User Content does not violate any
applicable laws and these Terms and Conditions (including Appex.Media End-User License
Agreement). Additionally, you understand and agree that Appex.Media shall have no
responsibility or liability whatsoever for User Content and copyrightable materials such as
literary works, phrases, entries, text, and any other materials, which may be provided to or in
the Services.
You shall not upload, transmit, create, store, edit, use or share any User Content violates
these Terms and Conditions (including Appex.Media End-User License Agreement) and other
applicable laws. You agree to indemnify and hold harmless the Indemnitees (as defined
under Appex.Media End-User License Agreement) in accordance with Article 15
“Indemnification” of the Appex.Media End-User License Agreement from any Claim (as defined
under Appex.Media End-User License Agreement) that alleges, directly or indirectly that any
User Content provided by you infringes the Intellectual Property Rights (as defined under
Appex.Media End-User License Agreement) of any third person or that directly or indirectly
results from your breach of these Terms and Conditions.
Furthermore, you understand and agree that (i) Output is generated by an Artificial
Intelligence; (ii) Output might be false, inaccurate or misleading; (iii) Appex.Media does not represent or warrant that Output is accurate, genuine or true; (iv) Output is not advice, guidance or information provided by Appex.Media in any way; (v) Appex.Media shall not have any
responsibility or liability whatsoever for Output. Additionally, you understand and agree that
Output may not be always unique as same or similar input provided by other users might
receive same or similar outputs.
Changes to This Terms and Conditions
We may unilaterally amend and update our Terms and Conditions from time to time. Thus,
you are advised to review this page periodically for any changes. We will notify you of any
changes by posting the new Terms and Conditions on this page. These amendments shall be
effective on the date when they are published. The User is obliged to follow these
amendments and updates and shall be deemed to have agreed with these amendments in
case the User confirms these amendments or continues to use the Talk AI App following the
publication.
The User acknowledges that it cannot gain a title and/or status of Appex.Media ’s representative,
authorized person, agent, commercial representative, stakeholder, solution or business
partner, dealer etc. by concluding these Terms and Conditions; therefore, the User shall not
be able to disclose a notification to be interpreted as such in any documents, brochures and
advertisements to be arranged by and between third parties, on its website or in its
references.
These Terms and Conditions are effective as of 28 Jule 2023.
