1. Acceptance of Terms
By downloading, installing, accessing, or using the PicsArt: Turn Photos to AI Art mobile application ("App" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the App.
2. Limited License
We grant you a personal, revocable, non-exclusive, non-transferable, limited license to download, install, and use the App solely for your personal, non-commercial use, strictly in accordance with these Terms.
3. User Input and AI-Generated Content
A. User Input
You confirm that you have the necessary rights, licenses, or permissions to use any photo you select from your phone (the "Input") for AI generation within the App. We are not responsible for any copyright or licensing violations resulting from the use of your Input.
B. Ownership of Output
The App's function is to generate a new image (the "Output") based on the Input and the AI model. To the fullest extent permitted by law:
You own the Output image you create using the App.
You are responsible for ensuring your use of the Output complies with all applicable laws and regulations.
You acknowledge that due to the nature of AI, other users may create similar or identical Output images, and you agree that you have no claim over such images created independently by others.
C. Content Disclaimer
The Output is generated by experimental artificial intelligence technology. We make no warranty or guarantee regarding the accuracy, quality, legality, or non-infringement of any third-party rights by the Output. You use the Output entirely at your own risk.
4. Prohibited Uses and User Conduct
You agree not to use the App in any way that is illegal, harmful, or inappropriate. You are prohibited from using the App to generate, upload, or share any Input or Output that:
Is unlawful, fraudulent, or promotes illegal activity.
Infringes upon any third party's intellectual property rights (copyright, trademark, etc.) or privacy rights.
Depicts or promotes violence, gore, hate speech, or sexually explicit material.
Is intended to harass, defame, or intimidate any person or group.
Attempts to develop machine learning models or any competitive software based on the App or its AI output.
5. In-App Purchases and Subscriptions
The App is provided to you free of charge but offers optional weekly or monthly subscriptions to unlock premium features and remove advertisements.
Billing: All purchases are processed by the third-party payment processor used by the App Stores (Apple App Store or Google Play Store). We do not collect or store your payment details.
Refunds and Cancellation: All transactions, cancellations, and refunds are governed by the respective App Store's terms and conditions.
6. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.
7. Limitation of Liability and Indemnification
THE APP IS PROVIDED "AS IS." We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the App; (ii) any conduct or content of any third party on the App; or (iii) unauthorized access, use, or alteration of your transmissions or content.
You agree to indemnify and hold harmless the Developer, Turker Alan, from any and all claims, damages, liabilities, costs, and expenses (including attorneys’ fees) arising from or in connection with your use of the App or your violation of these Terms.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Insert Your Governing Law Jurisdiction, e.g., the State of New York], without regard to its conflict of law provisions.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
