Spinny Driver – privacy and policy

These Terms and Conditions ("Terms") govern your use of the Spinny Driver mobile application ("Application"), operated by Plodding Tech Private Limited ("Service Provider", "we", "us", or "our").
The Spinny Driver Application is intended for authorized drivers and delivery personnel who use the platform to manage laundry pickup and delivery assignments, communicate with customers and the service team, and update order and delivery status.
By downloading, accessing, registering for, or using the Application, you agree to be bound by these Terms. Please read them carefully before using the Application.
1. Application and Services
Spinny Driver provides tools that allow authorized drivers to:
Receive and manage laundry pickup and delivery assignments.
View relevant order and customer information required to complete assigned deliveries.
View pickup and delivery addresses.
Navigate to pickup and delivery locations.
Update order and delivery statuses.
Communicate with customers and authorized Spinny personnel through chat and calling features.
Share or provide location information where required for pickup, delivery, navigation, safety, or operational purposes.
Receive notifications regarding assigned orders and delivery activities.
Maintain relevant driver and delivery information.
The Application is a service-management and delivery application and is not a healthcare, banking, financial, or medical application.
2. Driver Account
To use Spinny Driver, you may be required to create or be provided with an authorized driver account.
You are responsible for:
Providing accurate and current information.
Keeping your login credentials confidential.
Not sharing your account with another person.
Immediately notifying the Service Provider if you believe your account has been accessed without authorization.
Using the Application only for legitimate Spinny-related activities.
You are responsible for all activity performed through your account.
3. Location Services
Spinny Driver may use your device's location services to support driver and delivery functionality.
Location information may be used for purposes including:
Identifying the driver's current location.
Supporting navigation to pickup and delivery locations.
Helping coordinate assigned pickup and delivery orders.
Providing relevant delivery status information.
Supporting operational coordination between drivers, customers, and service providers.
Improving the accuracy and efficiency of delivery operations.
Supporting safety, service quality, and dispute resolution where appropriate.
Depending on the Application's functionality and device settings, location information may be collected while the Application is being used and, where necessary for an active delivery task, may continue to be processed when the Application is not displayed on screen.
You may control location permissions through your device settings. However, disabling required location permissions may prevent certain driver and delivery features from functioning correctly.
You should use location services only in accordance with applicable laws and while safely operating your vehicle.
4. Phone and Calling Features
Spinny Driver may provide calling functionality to allow drivers to communicate with customers, vendors, or authorized Spinny personnel regarding active orders and delivery activities.
Calling functionality may be used for purposes such as:
Coordinating pickup and delivery.
Contacting a customer regarding an order.
Resolving delivery-related issues.
Communicating with the laundry service or Spinny support team.
The Application may use the device's phone functionality or an applicable third-party communication service.
Drivers must use calling functionality responsibly and must not use customer contact information for personal, promotional, or unauthorized purposes.
5. Chat and Communication
Spinny Driver may provide in-app chat or messaging functionality.
Chat may be used for legitimate operational communication relating to:
Pickup and delivery.
Customer instructions.
Order-related issues.
Delivery coordination.
Communication with vendors or Spinny support.
You must not use the chat functionality to send unlawful, abusive, threatening, fraudulent, discriminatory, inappropriate, or unrelated promotional content.
The Service Provider may retain or review communications where reasonably necessary for service operation, customer support, safety, security, fraud prevention, dispute resolution, or compliance with applicable laws.
6. Personal Information
The Application may collect and process information necessary to provide driver and delivery services.
This may include, depending on the features you use:
Name and contact information.
Driver account information.
Profile information.
Location information.
Pickup and delivery information.
Order and delivery status information.
Device and application information.
Communication information.
Information required for verification, payments, or operational purposes.
Personal information is handled in accordance with the Spinny Privacy Policy.
7. Customer Information
During assigned deliveries, you may have access to limited customer information such as name, phone number, pickup or delivery address, and order details.
You agree to:
Use customer information only to complete assigned Spinny services.
Keep customer information confidential.
Not copy, sell, share, publish, or misuse customer information.
Not contact customers for personal purposes.
Not retain customer information after it is no longer required for legitimate business purposes, except where legally required.
Unauthorized use or disclosure of customer information may result in suspension or termination of your account and may also result in legal action where applicable.
8. Safe Use While Driving
You must not operate or interact with the Application in a way that creates a safety risk while driving.
You should:
Follow applicable traffic laws.
Use hands-free functionality where legally required.
Stop in a safe and lawful location before interacting with the Application when necessary.
Never type messages or perform activities on the Application that distract you from driving.
Safety while operating a vehicle takes priority over using the Application.
9. Third-Party Services
The Application may use third-party services to provide certain functionality, including mapping, authentication, communication, analytics, notifications, payment-related services, or other technical services.
Third-party services may have their own terms and privacy policies.
Examples may include services provided by:
Google Play Services
Google Maps or related mapping services
Firebase services
Communication or calling providers
Other infrastructure and technology providers used by Spinny
Your use of third-party services may be subject to their respective terms and conditions.
10. Internet and Mobile Data
Certain Application features require an active internet connection.
The Application may use Wi-Fi or mobile data to communicate with Spinny servers and third-party services.
Your mobile network provider's terms and charges continue to apply. You are responsible for any mobile data, roaming, or other telecommunications charges associated with your use of the Application.
The Service Provider is not responsible for interruptions caused by your mobile network provider, internet connection, device, or other circumstances outside our reasonable control.
11. Device Security
You are responsible for maintaining the security of the device used to access Spinny Driver.
We recommend that you:
Keep your device's operating system updated.
Use an appropriate device lock.
Keep your login credentials confidential.
Do not install the Application on compromised or unauthorized devices.
Rooting or jailbreaking your device may compromise security and may cause certain Application features to function incorrectly.
12. Prohibited Activities
You must not:
Use the Application for unlawful purposes.
Share or transfer your driver account.
Provide false information.
Manipulate location information or delivery status.
Falsify pickup or delivery information.
Attempt to access another user's account.
Reverse engineer, decompile, or modify the Application.
Attempt to extract the Application's source code.
Interfere with the Application or its servers.
Misuse customer information.
Use customer contact information for personal purposes.
Send abusive or inappropriate communications.
Attempt to circumvent security or authentication mechanisms.
Use the Application for unauthorized commercial or promotional activities.
13. Intellectual Property
All rights, title, and interest in the Application, including its software, design, branding, logos, graphics, text, databases, and related intellectual property, belong to Plodding Tech Private Limited or its applicable licensors.
You are granted a limited, non-exclusive, non-transferable, revocable right to use the Application solely for authorized Spinny driver activities.
You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from the Application unless expressly permitted by applicable law or authorized by the Service Provider.
14. Application Updates
We may periodically release updates, security fixes, feature improvements, or changes to the Application.
You agree to install updates when they are made available where necessary for continued access, security, or proper functioning of the Application.
We may change, suspend, or discontinue individual features or the Application itself when reasonably necessary.
15. Suspension and Termination
The Service Provider may suspend or terminate access to the Application where reasonably necessary, including if:
You violate these Terms.
Your driver authorization is suspended or terminated.
You misuse customer information.
You engage in fraudulent or unlawful activity.
You compromise the security of the Application.
Your account is inactive or no longer authorized.
Required by law or regulatory authorities.
Upon termination, your right to use the Application will end.
16. Disclaimer
We make reasonable efforts to keep the Application available and functioning properly. However, we do not guarantee that the Application will always be uninterrupted, error-free, secure, or available on every device or network.
Maps, GPS information, network connectivity, third-party services, and other external information may occasionally be inaccurate, delayed, unavailable, or interrupted.
The Service Provider is not responsible for problems caused by circumstances outside its reasonable control, including network failures, GPS limitations, device failures, third-party service interruptions, or telecommunications outages.
17. Limitation of Liability
To the extent permitted by applicable law, the Service Provider will not be responsible for losses resulting from:
Network or internet interruptions.
Device failure.
Incorrect or unavailable GPS information.
Third-party service failures.
Unauthorized use of your account resulting from your failure to protect your credentials.
Failure to maintain required device permissions.
Events outside the reasonable control of the Service Provider.
Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.
18. Changes to These Terms
We may periodically update these Terms and Conditions.
When changes are made, the updated version will be published through the Application or the relevant Terms and Conditions webpage.
Your continued use of Spinny Driver after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
19. Governing Law
These Terms shall be governed by and interpreted in accordance with the applicable laws of India.
Any disputes will be subject to the jurisdiction of the courts having appropriate jurisdiction, subject to applicable law.
