Terms and Conditions for Scirql

1. THE CONTRACTUAL RELATIONSHIP

These Terms and Conditions ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and Scirql Team ("Service Provider," "we," "us," or "our"). This Agreement governs your access to and use of the Scirql mobile application, website, and related services (collectively, the "App").

IMPORTANT: BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY CEASE ALL USE AND UNINSTALL THE APPLICATION.

2. DEFINITION OF SERVICE (DIGITAL REAL ESTATE)

Scirql is a hyperlocal community platform and a digital real estate provider. We offer a virtual space for users to post listings regarding local events, freelancing ("Works"), rentals (PGs, Hostels, Vehicles), and dining offers.

Non-Mediation: We do not act as an agent, broker, or mediator.

No Commission: We do not facilitate payments, escrow, or bookings.

P2P Nature: All interactions are strictly User-to-User (Peer-to-Peer).

3. ELIGIBILITY AND REGISTRATION

Age Requirement: You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872.

Verification: To maintain community integrity, we use Google Sign-In or Phone OTP. You agree to provide accurate, current, and complete information.

Account Responsibility: You are the sole custodian of your account. Any activity occurring under your credentials is deemed your responsibility. If you suspect a breach, contact us at scirql0@gmail.com immediately.

4. INTERMEDIARY STATUS & SAFE HARBOR

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, Scirql acts as an Intermediary.

Safe Harbor: We do not initiate the transmission, select the receiver of the transmission, or select/modify the information contained in any user-generated listing.

Due Diligence: We reserve the right to remove any content that violates these terms or the law upon receiving "actual knowledge" or a court/government order.

5. PROHIBITED CONTENT & CONDUCT

You agree that you will NOT post, upload, or share any content that:

Is defamatory, obscene, pornographic, pedophilic, or invasive of another's privacy.

Harasses or promotes discrimination based on race, religion, gender, or caste.

Includes "scams," fake job offers, or fraudulent rental listings.

Infringes upon any patent, trademark, copyright, or other proprietary rights.

Contains software viruses or any code designed to interrupt or limit the functionality of the App.

Threatens the unity, integrity, defense, security, or sovereignty of India.

6. SPECIFIC SERVICE DISCLAIMERS (P2P TRANSACTIONS)

A. Rentals (PGs, Hostels, Vehicles)

Scirql does not verify the legal ownership or physical condition of any listed property or vehicle. Users are strictly advised to:

Perform physical inspections before paying any deposit.

Verify the identity of the lister.

Avoid making advance payments via digital channels to unknown parties.

B. Freelancing ("Works")

The "Need Help" and "Open to Hire" sections are for discovery only.

No Employment: Scirql is not an employer. We do not provide insurance, tax withholding, or quality guarantees.

Payment Risks: Since we do not have an inbuilt payment gateway, all financial settlements are outside our purview. We are not liable for non-payment or sub-standard work.

C. Dining Offers

Offers listed by local vendors or individuals are subject to change. Scirql is not responsible for the hygiene, quality, or availability of food/services listed.

7. INTELLECTUAL PROPERTY RIGHTS

Our Property: The Scirql name, logo, UI/UX design, source code, and trademarks are the exclusive property of the Service Provider. You may not decompile, reverse engineer, or attempt to extract the source code of the Application.

User License: By posting content on Scirql, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, and display such content solely for the purpose of operating and promoting the Service.

8. AI INTEGRATION AND DATA USAGE

Scirql utilizes Artificial Intelligence (AI) to enhance user experience, moderate content, and provide recommendations.

Accuracy: You acknowledge that AI-generated content or filters may occasionally be inaccurate.

Data Processing: AI processing is conducted in compliance with our Privacy Policy.

Third-Party SDKs: We utilize AdMob, Firebase, and Expo. You are subject to their respective Terms and Conditions as well.

AI-Generated Content & User Conduct:

AI Identification (SGI Disclosure): “Users are hereby informed that the guidance assistant on this platform provides Synthetically Generated Information (SGI). All such content is generated algorithmically and should not be treated as a substitute for official university or legal advice.”

Prohibited AI Misuse: "Users are strictly prohibited from attempting to cause the AI to generate content that is obscene, deceptive, or depicts individuals in a non-consensual manner."

Periodic Legal Notifications: "As required by the IT Rules 2026, we will inform users every three months of their obligation to comply with these terms and the legal consequences of misusing our AI tools under the Bharatiya Nyaya Sanhita (BNS) 2023 and other applicable laws."

Accountability for Accuracy: "While we strive for accuracy, Scirql does not guarantee the factual correctness of AI-generated responses. Users interact with the AI assistant at their own risk."

9. TERMINATION AND BANNING POLICY

We reserve the absolute right to suspend or terminate your account without prior notice if:

You violate any provision of these Terms.

We receive multiple "Report" flags from verified users.

Your actions pose a legal or security risk to the Scirql community.

No Re-Entry: Banned users are strictly prohibited from circumventing bans by creating new accounts.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCIRQL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS) THE APP.

ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP (INCLUDING DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT).

ANY INTERACTIONS OR TRANSACTIONS RESULTING FROM USE OF THE APP.

11. TECHNICAL REQUIREMENTS & DATA CHARGES

Internet: The App requires an active internet connection. We are not responsible for data overages or lack of functionality due to poor connectivity.

Battery & Hardware: You are responsible for ensuring your device is charged and compatible with the latest version of the App.

Updates: You agree to accept all updates provided by us. Failure to update may result in the App ceasing to function.

12. GRIEVANCE REDRESSAL

In accordance with the IT Rules 2021, if you have any complaints regarding the platform or user content, please contact our Grievance Officer:

Timeline: We will acknowledge your complaint within 24 hours and aim to resolve it within 15 days.

13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the region where the Service Provider is based.
