PRIVACY POLICY

This Privacy Policy applies to the RefaceAi: Face Swap Changer mobile application and related services (collectively, the "Application") provided by TPK-40 (the "Service Provider").
This Privacy Policy explains what information may be collected when you use the Application, how that information is used and shared, and the choices available to you.
1. INFORMATION WE COLLECT
The Application may process the following categories of information:
• Photos and Images
When you choose to use an AI image-generation or image-editing feature, you voluntarily select and submit a photo or image from your device.
The Application does not require access to your entire photo library for the purpose of AI processing. Only the image selected by you for processing is intended to be submitted.
Selected images are transmitted to the Service Provider's backend infrastructure and may be transmitted to an AI service provider as described below in order to perform the requested image transformation.
You should only upload images that you have the right and permission to use.
• Network and Technical Information
When you communicate with the Service Provider's servers, technical information such as your IP address, request information, and basic network/server information may be processed as necessary to provide, secure, troubleshoot, and protect the service.
• Advertising and Device Information
The Application uses third-party advertising services.
Depending on your device, privacy choices, applicable law, permissions, and the configuration of third-party advertising services, information processed by advertising providers may include:
- IP address;
- advertising identifiers, such as the Android Advertising ID;
- device identifiers;
- device model and operating system information;
- network provider and connection information;
- advertising impressions and interactions;
- technical, diagnostic, and performance information.
The Service Provider does not require you to provide your name, telephone number, or email address in order to use the core AI image-generation functionality.
2. HOW WE USE INFORMATION
Information is processed for purposes including:
- receiving the image selected by you;
- performing the AI image transformation requested by you;
- returning the generated image to your device;
- operating and maintaining the Application;
- protecting the Application and backend services from abuse and unauthorized use;
- diagnosing technical problems;
- displaying and measuring advertising;
- complying with applicable legal obligations.
The Service Provider does not use uploaded photos for its own advertising purposes.
3. ARTIFICIAL INTELLIGENCE AND PHOTO PROCESSING
The Application provides features that use artificial intelligence to edit or transform images selected by the user.
When you request an AI transformation, the selected image and the information necessary to perform your requested transformation are securely transmitted over an encrypted HTTPS connection to the Service Provider's backend.
The backend may then transmit the image and the requested transformation instructions to OpenAI for the purpose of performing the AI processing.
The AI-generated result is returned through the Service Provider's backend to the Application and displayed to you.
The Service Provider does not use submitted photos to independently identify the people depicted in them.
Do not submit photos or other content that you do not have the right or appropriate permission to process.
4. PHOTO AND GENERATED IMAGE RETENTION
The Service Provider does not intend to maintain a permanent library of the photos you submit for AI processing.
Uploaded images are retained only for the time reasonably necessary to process the AI request, deliver the result, maintain service security, and handle temporary technical processing.
Temporary copies and generated results may exist for a limited period as part of active processing, temporary server storage, caching, security, or error handling, after which they are deleted or expire automatically from the Service Provider's active processing systems.
Third-party service providers may apply their own limited retention periods as described in their respective privacy policies and documentation.
5. ADVERTISING
The Application is supported by advertising and uses Appodeal and advertising services made available through the Appodeal platform.
The Application may display banner advertisements and rewarded advertisements.
A rewarded advertisement may be offered in connection with access to an AI generation feature.
Advertising providers may process device identifiers, advertising identifiers, IP addresses, device and network information, advertising interactions, and related technical information for purposes such as delivering advertisements, measuring advertising performance, fraud prevention, analytics, and, where permitted, advertising personalization.
Where required by applicable law, consent or other appropriate privacy choices will be provided before data is processed for purposes that require consent.
Your advertising choices may affect whether advertisements are personalized.
6. THIRD-PARTY SERVICE PROVIDERS
The Application relies on third-party service providers to provide certain functionality.
These providers include:
OpenAI
OpenAI provides artificial intelligence processing used to perform requested image transformations. Images and processing instructions may be transmitted to OpenAI when you request an AI image transformation.

Appodeal
Appodeal provides advertising monetization services, including banner and rewarded advertisements.

These third parties process information under their own privacy policies and applicable contractual and legal requirements.
Third-party advertising networks available through Appodeal may also process information according to their respective privacy policies.
7. DATA SHARING
The Service Provider may share or transmit information:
- to OpenAI when necessary to perform the AI transformation requested by you;
- to Appodeal and advertising providers for advertising delivery, measurement, fraud prevention, analytics, and related advertising purposes;
- to infrastructure or technical service providers where necessary to operate and secure the Application;
- where required by applicable law, regulation, legal process, or governmental request;
- where reasonably necessary to protect the security, rights, property, or safety of users, the Service Provider, or others.
The Service Provider does not sell uploaded user photos.
8. INTERNATIONAL DATA TRANSFERS
The Service Provider and third-party service providers may process information in countries other than the country in which you reside.
Where required by applicable data-protection law, appropriate safeguards will be used for international transfers of personal data.
Third-party providers are responsible for their processing practices as described in their respective privacy policies.
9. DATA SECURITY
The Service Provider takes reasonable technical and organizational measures designed to protect information processed through the Application.
Images transmitted between the Application and the Service Provider's backend are transmitted using encrypted HTTPS connections.
However, no electronic transmission or storage method can be guaranteed to be completely secure.
10. DATA RETENTION
The Service Provider retains personal data only for as long as reasonably necessary for the purposes described in this Privacy Policy, including providing the requested functionality, maintaining security, resolving technical problems, and complying with legal obligations.
Photos submitted for AI processing and generated results are not intended to be permanently stored by the Service Provider and are deleted or expire from active processing systems after the applicable temporary processing period.
Information processed independently by third-party providers may be subject to their respective retention policies.
11. YOUR PRIVACY RIGHTS
Depending on where you live, you may have rights regarding your personal data, including the right to:
- request access to personal data;
- request correction of inaccurate personal data;
- request deletion of personal data;
- object to or restrict certain processing;
- withdraw consent where processing is based on consent;
- request data portability where applicable;
- opt out of certain advertising-related processing where applicable.

12. DATA DELETION
You may request deletion of personal data held by the Service Provider by contacting:

Because the Application does not currently require a user account for its core functionality, there may be no persistent account associated with your use of the Application.
Photos submitted for AI processing are intended to be temporary and are not maintained by the Service Provider as a permanent user photo library.
Deletion requests will be handled in accordance with applicable law. Information may be retained where required by law or where another lawful basis for retention applies.
13. CALIFORNIA PRIVACY RIGHTS
Residents of California may have additional rights under applicable California privacy laws, including rights to know about certain personal information practices, request deletion or correction, and opt out of certain sharing or targeted advertising activities where applicable.
The Service Provider will not discriminate against you for exercising applicable privacy rights.

14. CHILDREN AND TEENAGERS
The Application is intended for users aged 13 and older.
The Application is not directed to children under 13, and the Service Provider does not knowingly collect personal information from children under 13.
Users between 13 and the age at which they can independently consent to certain processing under the laws applicable to them may require authorization from a parent or legal guardian for processing that requires consent.
Advertising and consent mechanisms may be adjusted where required by applicable law based on the user's age or jurisdiction.
If the Service Provider becomes aware that personal information from a child has been collected in violation of applicable law, reasonable steps will be taken to delete the information.

15. YOUR CHOICES AND CONSENT
Where consent is required by applicable law, the Application or relevant third-party service may request consent before carrying out processing that requires it.
You may be able to modify certain advertising and privacy choices through the consent interface provided in the Application or through your device settings.
You may stop future collection through the Application by uninstalling it. Uninstalling the Application does not necessarily delete information previously transmitted to third-party providers.
16. CHANGES TO THIS PRIVACY POLICY
The Service Provider may update this Privacy Policy when the Application, its data-processing practices, third-party services, or applicable legal requirements change.
The updated Privacy Policy will display a revised effective date.
Where required by applicable law, additional notice or consent will be provided for material changes.
