Property Inspection AI Terms of Use

These Terms of Use ("Terms") govern your access to and use of Property Inspection AI ("the App"), developed and operated by Silver Shark OÜ ("we", "our", "us"). By downloading, installing, or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.

1. ELIGIBILITY

You must be at least 18 years old and legally permitted to enter into contracts in your jurisdiction to use the App. The App is intended for use by professional home inspectors. By using the App you represent that you meet these requirements.

2. LICENSE

Subject to your compliance with these Terms and payment of any applicable subscription fees, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, solely for your personal professional purposes as a home inspector.

You may not: (a) copy, modify, or create derivative works of the App; (b) reverse engineer or decompile the App; (c) rent, lease, lend, sell, or sublicense the App; (d) use the App for any unlawful purpose or in violation of any applicable law or regulation.

3. SUBSCRIPTIONS AND BILLING

Available Plans

- Starter — $49.00 / month (or $468.00 / year, equivalent to $39/month): Unlimited inspections, AI-powered report writing, PDF export, and your name and license number on reports.
- Pro — $79.00 / month (or $756.00 / year, equivalent to $63/month): Everything in Starter, plus company logo, custom accent color, and custom report header and footer.
- Free Trial: One (1) complete inspection at no charge — full AI processing and PDF export included. No credit card required. Limited to one trial per Apple ID and per device.

Prices are in US Dollars and may vary by country due to local taxes and Apple's regional pricing.

Auto-Renewal

Subscriptions auto-renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the renewal date. Your Apple ID account will be charged within 24 hours prior to the end of the current period. Renewal prices will not increase without prior notice.

Managing and Cancelling

You can manage or cancel your subscription at any time in your device's Settings → [Your Name] → Subscriptions. Cancellation takes effect at the end of the current billing period; you retain access until then. We do not offer refunds for partial subscription periods except where required by applicable law.

Restore Purchases

If you reinstall the App or switch devices, use the "Restore Purchases" option in the App to reinstate an active subscription on the same Apple ID.

4. AI-GENERATED CONTENT

The App uses artificial intelligence (Anthropic's Claude API) to generate draft inspection finding descriptions, titles, and recommendations based on your raw notes and voice transcripts.

Inspector review required. All AI-generated text is a draft only. You, as the licensed inspector, are solely responsible for reviewing, editing, and approving all report content before sharing it with clients. AI-generated language may contain errors, omissions, or inaccuracies. Do not distribute any report without first reviewing it for accuracy. Every report generated by the App includes a disclaimer stating that AI-assisted language was reviewed and approved by the licensed inspector.

We make no warranty that AI-generated content is accurate, complete, or suitable for any particular inspection, property, or jurisdiction. Use of AI-generated content in professional reports is at your sole professional discretion and risk.

5. YOUR CONTENT

You retain ownership of all inspection data, photos, notes, and reports you create using the App ("Your Content"). By using the App you grant us a limited license to store, process, and transmit Your Content solely as necessary to provide the App's services to you.

We do not use Your Content — including property addresses, client names, inspection findings, or photos — to train AI models or for any purpose other than delivering the App's features to you.

6. PROHIBITED USES

You agree not to use the App to:
- Create fraudulent, misleading, or deliberately inaccurate inspection reports
- Violate any applicable law, regulation, or professional licensing requirement
- Infringe the intellectual property rights of any third party
- Attempt to gain unauthorized access to our systems or other users' data
- Share your account credentials with others
- Circumvent subscription requirements through multiple accounts or device transfers

7. INTELLECTUAL PROPERTY

The App, including its design, code, trademarks, and all content we provide (excluding Your Content), is owned by Silver Shark OÜ or its licensors and protected by applicable intellectual property laws. Nothing in these Terms transfers any of our intellectual property rights to you.

8. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. AI-GENERATED CONTENT IS PROVIDED WITHOUT ANY WARRANTY OF ACCURACY OR FITNESS FOR PROFESSIONAL USE.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SILVER SHARK OÜ AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. INDEMNIFICATION

You agree to indemnify and hold harmless Silver Shark OÜ from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the App in violation of these Terms; (b) Your Content; (c) your violation of any applicable law or third-party rights; or (d) any inspection report you distribute to clients.

11. TERMINATION

We may suspend or terminate your access to the App at any time if we reasonably believe you have violated these Terms, without prior notice or liability. You may terminate your use at any time by cancelling your subscription and deleting the App. Upon termination, your license ends; Sections 5 (Your Content), 7–10, and 12 survive termination.

12. GOVERNING LAW

These Terms are governed by the laws of the Republic of Estonia, without regard to conflict of law principles. Any disputes that cannot be resolved informally shall be submitted to the courts of Tallinn, Estonia, except where prohibited by applicable consumer protection law in your jurisdiction.

13. CHANGES TO THESE TERMS

We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email. The "last updated" date at the top of this page always reflects the most recent version. Continued use of the App after changes constitutes your acceptance of the updated Terms.
