# PilotBound Terms of Service and Disclaimers

These Terms of Service ("**Terms**") govern your access to and use of the PilotBound mobile application (the "**App**"), operated by FlightXplorer LLC. ("**FlightXplorer**," "**we**," "**us**," or "**our**"). By creating an account, signing in, or otherwise using the App, you agree to these Terms and our [Privacy Policy](#). If you do not agree, do not use the App.
**These Terms contain important aviation safety disclaimers, limitations of our liability, and a binding arbitration agreement (Section 17). Please read carefully.**

## 1. The App
PilotBound is a personal flight-training companion for student pilots. Features include:
- A personal logbook for recording flights
- Automatic GPS recording of in-progress flights
- Aviation weather (METAR / TAF) lookups
- A community feed for sharing flights, asking questions, and celebrating milestones
- Optional connection with your flight school so the school can see your training momentum
- Achievements, milestone tracking, and a personal training-momentum indicator
- Optional cost-to-certificate tracking — record per-flight cost and one-time expenses, save aircraft hourly rates, and view a projected total cost to your next certificate based on your own data plus national-average reference figures
**The App is a record-keeping and learning tool. It is not an instrument of flight, a navigation device, an Electronic Flight Bag (EFB), an authoritative weather source, an official FAA pilot logbook, financial advice, or a quote for the cost of training.** See Section 14 for the full safety and cost-projection disclaimers.

## 2. Eligibility
You must be at least **13 years old** to create an account. If you are between 13 and the age of majority where you live, you may use the App only with the involvement and consent of a parent or legal guardian.
By using the App you represent that you meet the above eligibility requirements and that all information you provide is accurate and current.

## 3. Your Account
### 3.1 Creating an Account
You may create an account using email and password or Sign in with Apple. You agree to provide accurate information and to keep it up to date.
### 3.2 Account Security
You are responsible for maintaining the confidentiality of your sign-in credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized access.
### 3.3 One Account Per Person
Each account is for one individual. You may not share your account, sell it, or transfer it.
### 3.4 Email Verification
Some features (such as posting in the community) require you to verify your email address. You agree to verify when prompted.

## 4. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations
- Misrepresent your identity, training status, certificates, or affiliation with any flight school
- Upload, post, or share content that is unlawful, infringing, defamatory, harassing, threatening, hateful, sexually explicit, or that depicts dangerous or unsafe aviation practices
- Impersonate another pilot, instructor, school, or organization
- Spam, scrape, or attempt to extract bulk data from the App or our servers
- Attempt to reverse engineer, decompile, or otherwise interfere with the App, our servers, or any security mechanisms (including Firebase App Check)
- Use the App to log flights you did not actually conduct, or to fabricate training records
- Interfere with another user's enjoyment of the App, including through harassment of other users in the community
- Use the App in connection with the operation of an unmanned aircraft system (drone) outside the scope of an authorized flight-training context
- Use the App in any manner that could disable, overburden, or impair our infrastructure
We reserve the right to remove content, suspend or terminate accounts, and report unlawful activity to authorities.

## 5. Community Content
### 5.1 Your Content
You retain ownership of any content you post — including text, photos, comments, and flight data ("**Your Content**").
### 5.2 License You Grant Us
By posting Your Content in the App, you grant FlightXplorer a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (e.g., resize photos), publicly display, distribute, and translate Your Content for the limited purpose of operating, providing, and promoting the App. This license ends when you delete the content or your account, except for backups and tombstoned attribution as described in our Privacy Policy.
You additionally grant FlightXplorer a perpetual, irrevocable, worldwide, royalty-free license to create aggregated and de-identified datasets, statistics, benchmarks, and research derived from Your Content (including flight data and logbook entries) and to use, retain, publish, share, and commercialize that aggregated and de-identified output for the purposes described in Section 1.11 of our Privacy Policy. This license survives deletion of the underlying content or your account. The resulting aggregated and de-identified data is not "Your Content," does not identify you, and is not subject to the deletion provisions of these Terms or the Privacy Policy.
### 5.3 Responsibility
You are solely responsible for Your Content. You represent that you have the rights to post it, that it does not violate the rights of any third party, and that it complies with these Terms.
### 5.4 Reporting and Moderation
You may report content that violates these Terms. We may, but are not obligated to, monitor, edit, or remove any user content. We reserve the right to remove content and suspend accounts at our discretion.

## 6. School Affiliation (Optional)
If you choose to connect with a flight school inside the App:
- You explicitly consent to share specific data fields (your first name and last initial, momentum score, last flight date, recent flight count, and total hours) with that school. The complete list is shown in the consent screen at the time you affiliate.
- We never share your GPS tracks, logbook details, community content, photos, or email address with the school.
- You may disconnect from the school at any time from the Profile screen. Disconnection takes effect immediately.
- Your school is a separate party. The school's use of the data you share with it is governed by the school's own policies, not these Terms or our Privacy Policy.

## 7. Logbook and Cost Data
### 7.1 Logbook Data
You are responsible for the accuracy of any logbook entries you make in the App. The App may automatically populate certain fields (e.g., total time, distance, landings) from GPS data; you remain responsible for reviewing and correcting these values before treating them as accurate.
**The App's logbook is not an official FAA pilot logbook.** See Section 14.2.
### 7.2 Cost Data
You are responsible for the accuracy of any cost data you enter — including aircraft hourly rates, instructor rates, expense amounts and categories, the certificate each item applies to, your "before tracking" baseline (prior hours flown and money spent), and any overrides you set to the App's national-average estimates. The App may pre-fill a flight's cost from your default or aircraft-specific rates multiplied by total time; you must review and correct the pre-filled value before saving it.
**Cost projections in the App are estimates only and are not financial advice or a quote.** See Section 14.9.

## 8. Intellectual Property
### 8.1 Our Property
The App, including its software, design, branding, logos, text, graphics, and other content (excluding Your Content and content provided by third parties), is owned by FlightXplorer or its licensors and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.
### 8.2 Feedback
If you submit suggestions, ideas, or feedback about the App, you grant us a perpetual, worldwide, royalty-free license to use them without obligation to you.
### 8.3 DMCA / Copyright Complaints
If you believe content in the App infringes your copyright, please send a written notice including (a) your contact information, (b) identification of the copyrighted work, (c) the location of the allegedly infringing material in the App, (d) a statement of good-faith belief that the use is not authorized, (e) a statement under penalty of perjury that the notice is accurate and you are authorized to act, and (f) your physical or electronic signature, to: **info@flightxplorer.com**.

## 9. Third-Party Services and Content
The App relies on third-party services (such as Firebase, Firebase Crashlytics for crash and stability diagnostics, Apple, and AVWX for aviation weather) and may display information that originates from third parties (such as METAR/TAF reports). We do not control and are not responsible for third-party services or content. Your use of third-party services may be subject to their separate terms and privacy policies. The data we share with each provider, and the limits on that sharing, are described in our Privacy Policy.

## 10. Subscriptions and Payments
The App is currently free to use. If we introduce paid features in the future, the applicable terms, prices, billing cycles, and refund policies will be presented to you before purchase, and additional terms may apply at that time.

## 11. Termination
### 11.1 By You
You may delete your account at any time from **Profile → Delete Account** in the App. Deletion is permanent and removes your data as described in our Privacy Policy.
### 11.2 By Us
We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, posed a risk to other users, or engaged in fraudulent or illegal activity, or if required by law.
### 11.3 Effect of Termination
On termination, your license to use the App ends. Sections that by their nature should survive termination (including Sections 5.2, 8, 12, 13, 14, 15, 16, and 17) will survive.

## 12. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, RELIABLE, COMPLETE, SECURE, OR TIMELY; THAT GPS TRACKING WILL BE CONTINUOUS OR ACCURATE; THAT WEATHER DATA WILL BE CURRENT OR ACCURATE; OR THAT TRAINING-PROGRESS INDICATORS WILL REFLECT YOUR ACTUAL READINESS FOR ANY EXAM, CHECKRIDE, OR FLIGHT.
Some jurisdictions do not allow exclusion of certain warranties, so some of the above may not apply to you.

## 13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
(a) FLIGHTXPLORER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
(b) WE WILL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, INJURIES, OR DEATHS ARISING OUT OF OR RELATING TO YOUR PILOTING DECISIONS, FLIGHT OPERATIONS, RELIANCE ON GPS DATA, RELIANCE ON WEATHER DATA, RELIANCE ON LOGBOOK CALCULATIONS, RELIANCE ON TRAINING-PROGRESS INDICATORS, OR YOUR USE OR INABILITY TO USE THE APP DURING ANY ASPECT OF FLIGHT.
(c) OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (i) THE TOTAL AMOUNT YOU HAVE PAID US (IF ANY) IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (ii) ONE HUNDRED U.S. DOLLARS ($100).
The limitations in this Section apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.

## 14. Aviation Safety Disclaimers
**Aviation involves serious risks. Read this section carefully.**
### 14.1 Not for Navigation
The App is **not** designed for and **must not be used for** primary aircraft navigation, situational awareness, terrain or traffic avoidance, IFR operations, or any other operational decision in flight. The App is not certified by the FAA, EASA, or any other aviation authority. Do not rely on it as a substitute for properly maintained, certified, and current aeronautical charts, instruments, navigation systems, or briefings.
GPS recording is provided as a personal record only. GPS signal can be lost, degraded, or inaccurate due to terrain, weather, antenna position, multipath error, iOS power management, app or device crashes, network outages, and other factors. Recorded tracks may have gaps, jumps, drift, or other errors. **Never use a PilotBound track for navigation, course reconstruction in safety investigations, or any flight-critical purpose.**
### 14.2 Not an Official FAA Logbook
The App is a personal record-keeping tool. It is **not** an official pilot logbook and does **not** satisfy the logbook requirements of 14 CFR § 61.51 or the analogous regulations of any other aviation authority.
You are solely responsible for maintaining a separate, official logbook in accordance with the regulations that apply to you. Entries in the App may not be relied upon as the sole record for certificate or rating applications, flight reviews, instrument currency, recency-of-experience requirements (e.g., 14 CFR §§ 61.56, 61.57), or any insurance, employment, or regulatory submission.
You are responsible for the accuracy of every entry. The App may auto-populate certain fields from GPS data; you must verify them before treating them as authoritative. Your CFI's signature in your official logbook (where required) cannot be replicated in the App.
### 14.3 Weather Data Is Informational Only
Weather information in the App (METARs, TAFs, and any derived displays) is provided by third parties for general informational purposes. **It is not a substitute for an official preflight weather briefing.** You must obtain a complete weather briefing from an authoritative source — such as Flight Service (1-800-WX-BRIEF or 1800wxbrief.com), an authorized weather provider, or your school's dispatch — before every flight. Weather data in the App may be delayed, cached, incomplete, inaccurate, or stale, and may not include SIGMETs, AIRMETs, PIREPs, NOTAMs, TFRs, or other safety-of-flight information.
### 14.4 Training Momentum, Streaks, and Milestones Are Heuristics
The App's training momentum score, streak counter, and milestone indicators are **heuristic engagement features** based on the dates and counts you log. They:
- Do not assess the **quality** of any flight or training event
- Do not validate FAA hour minimums, Part 141 stage check requirements, endorsement requirements, or any other regulatory criterion
- Do not constitute a flight evaluation, instructor recommendation, or fitness-to-fly determination
- Are not a substitute for your CFI's professional judgment
Your CFI, your flight school, and the applicable Federal Aviation Regulations (or equivalent in your country) are the **only** authoritative source for whether you are ready to solo, take a checkride, or operate as pilot in command. **Always defer to your CFI.**
### 14.5 Auto-Detected Milestones
The App may automatically mark milestones (e.g., first night flight, first solo cross-country) when entries you log meet certain thresholds. These auto-detections are based **only** on data you yourself enter. They are not verified by us, your school, your CFI, or any regulatory authority. They have no regulatory or training-credit significance.
### 14.6 Pilot in Command Responsibility
Per 14 CFR § 91.3, the pilot in command is the final authority as to the operation of the aircraft. Nothing in the App relieves you of that responsibility. Decisions about whether, when, where, and how to fly are yours alone. **Do not let the App distract you in flight.** Do not let any feature of the App pressure you into flying when conditions, equipment, or your readiness do not warrant it.
### 14.7 Use During Flight
You should not interact with the App during taxi, takeoff, climb, approach, landing, or any phase of flight where attention to operation of the aircraft is required. Operate the App in a manner consistent with safe single-pilot resource management, sterile-cockpit principles, and your school's policies on the use of personal electronic devices during flight.
### 14.8 Drone, UAS, and Non-Manned Operations
The App is intended for use by student pilots of manned aircraft. The App is not designed for, certified for, or warranted for use in connection with the operation of any unmanned aircraft system (drone), and we disclaim all liability for any such use.
### 14.9 Cost Projections Are Estimates, Not Quotes
Cost projections, dollar ranges, "still ahead" forecasts, "what if you flew more or less" scenarios, "by aircraft" breakdowns, "lifetime equipment" totals, and any other forward-looking or aggregate cost figures in the App are **estimates only**. They are derived from a combination of:
- The hourly rates, expenses, baseline figures, and flight cost values you yourself enter; and
- National-average reference figures (typical hours-to-certificate and typical one-time-fee amounts) that we ship with the App from publicly available sources.
These figures are **not** a quote, contract, guarantee, or promise. They are **not** financial, legal, tax, accounting, or training advice. Actual training costs vary substantially by individual pilot, instructor, school, aircraft availability, weather, ground-school path, time of year, exchange-rate movement, fees not modeled by the App, and many other factors outside the App's view. The App does not collect bills, invoices, statements, or payments — it tracks only the figures you enter.
**Do not rely on a cost projection as the basis for any financial decision, loan application, school enrollment, employment commitment, contract, or other obligation.** Verify any pricing with your flight school, instructor, designated examiner, and any other counterparty before committing money. To the fullest extent permitted by law, we disclaim all liability for any financial decision you make in reliance on a cost projection or any other cost figure in the App.
National-average reference figures (for example, "78 hours typical for a Part 141 Private Pilot certificate") are derived from publicly available sources, are not customized to your specific school, region, or circumstances, and may be updated in future versions of the App without notice.

## 15. Indemnification
You agree to indemnify, defend, and hold harmless FlightXplorer and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
(a) your use of the App;
(b) your violation of these Terms;
(c) your violation of any rights of another (including intellectual property and privacy rights);
(d) Your Content; or
(e) any flight, training event, or piloting decision made by you or any third party.

## 16. Modifications to the App and These Terms
We may modify or discontinue the App, in whole or in part, at any time, with or without notice. We may update these Terms from time to time. If we make material changes, we will notify you in the App and update the "Last Updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

## 17. Dispute Resolution; Governing Law; Arbitration
### 17.1 Governing Law
These Terms and any dispute arising out of or relating to them or the App are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-laws principles.
### 17.2 Informal Resolution
Before filing a claim, you agree to try to resolve the dispute by contacting us at **info@flightxplorer.com** and providing a brief written description of the dispute. We will attempt to resolve it informally within 60 days.
### 17.3 Binding Arbitration
If we cannot resolve a dispute informally, you and FlightXplorer agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App will be resolved by **binding arbitration** administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive or equitable relief in court for intellectual-property infringement.
The arbitration will take place in United States, Wyomying, or, at your election, by phone or video. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.
### 17.4 Class Action Waiver
**You and FlightXplorer agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.** The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
### 17.5 Opt-Out
You may opt out of Sections 17.3 and 17.4 by sending written notice to **info@flightxplorer.com** within 30 days of first accepting these Terms. The notice must include your name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration.
### 17.6 Small Claims
Either party may bring a qualifying claim in a small-claims court instead of arbitration.

## 18. Apple-Specific Terms
The App is licensed (not sold) to you for use only under these Terms and the Apple App Store's Licensed Application End User License Agreement ("**Apple EULA**"). The following additional terms apply because you obtained the App through the Apple App Store:
- These Terms are between you and FlightXplorer, not Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are governed by these Terms.
- Apple is not responsible for addressing any claims by you or a third party relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, or claims under consumer-protection or similar laws.
- If a third party claims that the App infringes intellectual-property rights, FlightXplorer (not Apple) is solely responsible for investigation, defense, settlement, and discharge of the claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

## 19. Miscellaneous
### 19.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FlightXplorer regarding the App and supersede any prior agreements.
### 19.2 Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in effect.
### 19.3 No Waiver
Our failure to enforce any right or provision will not be deemed a waiver of that right or provision.
### 19.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms freely.
### 19.5 Notices
We may give notices to you by email, in-app message, or by posting them in the App. You may give notices to us at **info@flightxplorer.com**.
### 19.6 Force Majeure
We are not liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network or service outages, or labor disputes.
