MyWorkoutPal — Terms of Service

1. Acceptance of Terms

By downloading, installing, or using MyWorkoutPal (the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your jurisdiction) to use the App. If you are under 18, you must have permission from a parent or legal guardian.

3. Your Account

You are responsible for maintaining the confidentiality of your device and account credentials and for all activity that occurs under your account.

4. Subscriptions, Billing, and Auto-Renewal

MyWorkoutPal offers the following auto-renewing subscriptions, purchased through the Apple App Store:

  • Monthly: $12.99 USD per month
  • Yearly: $29.99 USD per year, with a 3-day free trial for new subscribers

Auto-renewal disclosure (required by Apple):

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
  • You can manage and cancel your subscriptions by going to your Apple ID account settings in the iPhone Settings app.
  • If you cancel during the free trial, you will not be charged. Any unused portion of a free trial period is forfeited when you purchase a subscription.

Prices are stated in U.S. dollars; the App Store will display your local currency equivalent. Apple may change the price converted into local currency without notice.

5. Free Trial

If offered, the free trial applies only to new subscribers who have not previously subscribed. The trial automatically converts to a paid subscription at the end of the trial period unless canceled at least 24 hours before the trial ends.

6. Restore Purchases

If you have previously subscribed and reinstall the App or install it on another device signed in to the same Apple ID, you can restore your subscription via the "Restore Purchases" button on the paywall screen.

7. Refunds

All purchases are processed by Apple. We do not process refunds directly. Refund requests must be made through Apple at https://reportaproblem.apple.com. Apple's refund policies govern.

8. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

9. Acceptable Use

You agree NOT to:

  • Reverse-engineer, decompile, or attempt to extract source code from the App.
  • Use the App for any unlawful purpose.
  • Interfere with or disrupt the App or its servers.
  • Resell, sublicense, or redistribute the App or its content.
  • Circumvent subscription gating or authentication mechanisms.
  • Use automated systems (bots, scrapers) to access the App.

10. AI-Generated Content

Workout and nutrition plans are generated in part by artificial intelligence based on the information you provide. AI output may contain errors, omissions, or generic recommendations. You are responsible for evaluating whether any plan is suitable for you.

11. Not Medical Advice

MyWorkoutPal is not a medical device and does not provide medical advice, diagnosis, or treatment. The App is intended for general fitness and informational purposes only.

  • Consult a qualified physician or healthcare provider before beginning any exercise or nutrition program, especially if you have any pre-existing condition, injury, are pregnant, or are taking medication.
  • Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other symptom.
  • You assume all risks associated with physical activity. You use the App at your own risk.

12. User Content

If you enter notes, workout logs, or other content ("User Content"), you retain ownership. You grant us a non-exclusive, worldwide, royalty-free license to store, process, and display that content solely to operate the App for you.

13. Intellectual Property

The App, including its design, code, logos, text, graphics, and plan templates, is owned by us and protected by copyright, trademark, and other laws. Except for the limited license in Section 8, no rights are granted.

14. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL MEET YOUR EXPECTATIONS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.

Some jurisdictions do not allow these limitations; in such cases, the limitations apply to the maximum extent permitted.

16. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the App or breach of these Terms.

17. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms. You may terminate your subscription through your Apple ID settings at any time. Provisions that by their nature should survive termination (IP, disclaimers, limitation of liability, indemnification) will survive.

18. Apple-Specific Terms

You acknowledge that these Terms are between you and us, not Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for addressing any claims relating to the App, including product liability, non-conformance to law, or intellectual property claims. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

19. Governing Law and Disputes

These Terms are governed by the laws of the State of [Your State], USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in [Your County], [Your State], and you consent to their jurisdiction.

20. Changes to Terms

We may update these Terms from time to time. We will post the revised version in the App and update the "Last Updated" date. Continued use after changes means you accept the new Terms.
