Information Collection and Use
The Application collects information when you download and use it. This information may include information such as:
- Your device's Internet Protocol address
- The pages of the Application that you visit, the time and date of your visit, and the time spent on those pages
- The time spent on the Application
- The mobile operating system you use
- Information you provide when using features of the Application
- Photos, images, or other media that you choose to upload, capture, or submit through the Application
The information collected is used to provide, maintain, improve, and secure the Application and its features, as well as to provide services that you request.
Photos, Camera Access, and Image Analysis
The Application may request access to your device's photo library and camera when you choose to use features that require selecting, capturing, or analyzing images.
Photo Library: You may select photos from your device's photo library for use within the Application. The Application accesses photos only when you choose to use a feature that requires photo selection and subject to the permissions provided by your device.
Camera: The Application may request access to your device's camera when you choose to take a photo within the Application. Camera access is used only for features that require capturing an image.
Image Analysis: When you choose to use an image analysis feature, the selected or captured image may be uploaded to the Service Provider's backend servers and/or third-party artificial intelligence (AI) service providers for processing. The image may be analyzed to identify or interpret visual details, objects, text, scenes, or other information contained in the image, depending on the feature you use.
Backend Processing: Images submitted for analysis may be transmitted through the Application to the Service Provider's backend infrastructure. The backend may process, temporarily store, transmit, or otherwise handle the image as necessary to provide the requested image analysis functionality.
Third-Party AI Providers: The Service Provider may use trusted third-party AI, cloud, hosting, storage, and processing providers to provide image analysis and other Application functionality. When you use an image analysis feature, your selected or captured image and information necessary to perform the requested analysis may be transmitted to these providers.
These service providers are authorized to process information on behalf of the Service Provider as necessary to provide the requested functionality and are expected to maintain appropriate security and privacy protections.
User Choice: Uploading or capturing an image is initiated by you. You can choose whether to use features that require access to your photos or camera. You may revoke photo library or camera permissions at any time through your device settings.
No Background Camera Access: The Application does not access or use your device's camera in the background without your interaction and the permissions required by the applicable operating system.
By using an image analysis feature, you acknowledge that the image you select or capture may be transmitted to the Service Provider's backend and/or third-party AI service providers for the purpose of providing the requested image analysis functionality.
Cookies and Tracking Technologies
The Application or its third-party SDKs may use cookies, SDKs, pixels, and similar technologies to support functionality, analytics, security, or service delivery.
Where required by applicable law, the Service Provider will obtain consent before using non-essential tracking technologies.
Your Rights
You may request access to, correction of, or deletion of your personal data held by the Service Provider.
You may also request information about how your personal data is processed and, where applicable, object to or restrict certain processing activities.

Your California Privacy Rights (CCPA/CPRA)
If you are a California resident, you may have the following rights under applicable California privacy laws:
- The right to know what personal information is collected about you
- The right to request deletion of personal information
- The right to correct inaccurate personal information
- The right to opt out of the sale or sharing of personal information
- The right to limit certain uses and disclosures of sensitive personal information, where applicable
- The right to non-discrimination for exercising your privacy rights
The Service Provider does not sell user-submitted photos to third parties.

The Service Provider may use the information you provide to send important information, required notices, and, where permitted by law, marketing communications.
For a better experience while using the Application, the Service Provider may require you to provide certain personally identifiable information. The information the Service Provider requests will be retained and used as described in this Privacy Policy.
Third Party Access
The Service Provider may use trusted third-party service providers to operate, maintain, secure, analyze, and improve the Application and to provide features requested by users.
When you use image analysis features, photos or other images that you choose to upload or capture may be transmitted to the Service Provider's backend infrastructure and to third-party AI, cloud, hosting, storage, or processing providers acting on the Service Provider's behalf.
These providers may process submitted images and related information solely as necessary to provide the requested service, subject to applicable contractual, security, and privacy requirements.
The Service Provider may also share aggregated or anonymized information with external services for analytics, service improvement, and other legitimate purposes.
The Service Provider does not sell user-submitted photos to third parties. Third-party service providers are not authorized to use user-submitted images for purposes unrelated to providing the Application's requested functionality, except where otherwise disclosed to the user or required or permitted by applicable law.
The Service Provider may disclose User Provided and Automatically Collected Information:
- as required by law, such as to comply with a subpoena or similar legal process;
- when the Service Provider believes in good faith that disclosure is necessary to protect its rights, protect the safety of the Service Provider, users, or others, investigate fraud, or respond to a government request;
- to trusted service providers who work on behalf of the Service Provider, do not have an independent use of the information disclosed to them, and have agreed to adhere to applicable privacy and security requirements.
International Data Transfers
The Service Provider or its third-party service providers may transfer personal data to countries outside your country of residence, including outside the European Economic Area (EEA).
Where applicable law requires safeguards for international transfers, the Service Provider will use appropriate mechanisms, which may include:
- Standard Contractual Clauses (SCCs) approved by the European Commission
- Adequacy decisions or other legally recognized transfer mechanisms
- Your consent, where required and legally permitted
Data protection laws in other countries may differ from those in your jurisdiction. Where required by law, the Service Provider will apply appropriate safeguards and obtain any consent required for the transfer.
Opt-Out Rights
You can stop further collection of information from your mobile device by uninstalling the Application.
Uninstalling will stop the Application from collecting data from your device, but it does not automatically delete information that has already been transmitted to the Service Provider or to third parties.
You may also withdraw permissions granted to the Application, including camera and photo library permissions, through your device settings.

Data Retention Policy
The Service Provider retains personal data based on its necessity for the stated purposes:
- User Provided Data: Retained for the duration of your use of the Application plus 12 months thereafter, unless longer retention is required by law.
- Automatically Collected Data: Retained for up to 24 months from collection, unless longer retention is required for legal compliance.
- Images Submitted for Analysis: Images uploaded or captured for image analysis may be retained temporarily on the Service Provider's backend systems and/or by third-party processing providers for as long as reasonably necessary to provide the requested functionality, maintain security, prevent abuse, troubleshoot issues, or comply with legal obligations. Where the Application or relevant service does not require longer retention, images should be deleted or otherwise disposed of after they are no longer reasonably necessary for these purposes.
- Aggregated and Anonymized Data: Retained indefinitely where the data no longer identifies you.
- Data Required for Legal Compliance: Retained for as long as required by applicable law.
You may request deletion of your personal data, subject to any legal obligation to retain it.
If you want the Service Provider to delete User Provided Data submitted through the Application, please contact the Service Provider at lundy.don76@gardenfairy.site.
Please note that some User Provided Data may be required for the Application to function properly.
Children
The Application is not intended for children under 13 years of age, or such higher age as required by applicable law.
The Service Provider does not knowingly solicit data from children or market the Application to them.
The Service Provider does not knowingly collect personally identifiable information from children. The Service Provider encourages parents and legal guardians to monitor their children's Internet usage and to help enforce this Policy by instructing children not to submit personally identifiable information through the Application and/or Services without appropriate permission.
If you have reason to believe that a child has provided personally identifiable information to the Service Provider through the Application and/or Services, please contact the Service Provider so that the Service Provider can take appropriate action.
If you are under 13 years of age, your parent or guardian must provide consent on your behalf where permitted by law.
Security
The Service Provider is concerned about safeguarding the confidentiality of your information.
The Service Provider provides physical, electronic, and procedural safeguards designed to protect the information it processes and maintains.
However, no method of transmission over the Internet or method of electronic storage is completely secure, and the Service Provider cannot guarantee absolute security.
Data Breach Notification
If a data breach occurs that affects your personal data, the Service Provider will notify you in accordance with applicable legal requirements, including, where required, providing information about the nature of the breach and the steps being taken to address it.
Changes
The Service Provider may update this Privacy Policy from time to time.
The Service Provider will notify you of material changes by posting the updated Privacy Policy with an effective date. Where required by law, the Service Provider will seek your consent to material changes before they take effect.
Previous versions of this Privacy Policy will be maintained and made available upon request by contacting the Service Provider.
This Privacy Policy is effective as of August 1, 2026.
Your Consent
Where processing is based on consent, you provide that consent by affirmatively opting in to the relevant feature or action.
You may withdraw consent at any time without affecting processing carried out before withdrawal.
Processing based on other lawful bases is carried out as described in this Privacy Policy.
By using features that require photo library, camera, or image analysis access, you acknowledge that the selected or captured images may be processed by the Service Provider's backend and third-party service providers as described in this Privacy Policy.
