Terms of Use for MindMate

1. Acceptance of Terms

Welcome to MindMate ("we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the MindMate mobile app ("the App"), which includes the AI chat assistant powered by the OpenAI API. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Use of the App

2.1 Account Creation

To access certain features of the App, you may be required to create an account. You must provide accurate and complete information when creating your account, and you are solely responsible for maintaining the confidentiality of your account credentials.

2.2 Subscription

Some features or services provided by the App may require a paid subscription. By subscribing to these features or services, you agree to pay the applicable fees and abide by any additional terms or conditions associated with the subscription.

3. Intellectual Property Rights

The App, including its content, features, and functionality, is owned by MindMate or its licensors and is protected by intellectual property laws. You may not modify, reproduce, distribute, or create derivative works based on the App without our prior written consent.

4. User Conduct

When using the App, you agree to:

  • Use the App for lawful purposes and in compliance with these Terms.
  • Respect the intellectual property rights of others.
  • Not use the App to transmit any viruses, malware, or other malicious code.
  • Not engage in any activity that could disable, overburden, or impair the functioning of the App.

5. Disclaimer of Warranty

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

6. Limitation of Liability

IN NO EVENT SHALL MindMate, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE APP, INCLUDING ANY DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE APP.

7. Modification or Termination of the App

We reserve the right to modify or terminate the App, in whole or in part, at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or termination of the App.

8. Entire Agreement

These Terms constitute the entire agreement between you and MindMate regarding the App and supersede all prior and contemporaneous agreements, understandings, or representations.
