These Terms and Conditions (“Terms”) govern your use of the Memories: Things We Keep application (“Memories”, “the App”, “we”, “us”, or “our”).
By downloading, accessing, or using Memories, you agree to these Terms. If you do not agree with them, please do not use the App.
1. The Memories service
Memories allows you to:
- Capture physical objects using your device camera.
- Generate interactive 3D representations of captured objects.
- View, rotate, and explore objects in 3D.
- Place objects in augmented reality.
- Organize memories in personal memory boxes.
- Add titles, descriptions, stories, voice recordings, people, dates, and locations.
- Customize memory boxes with patterns, colors, and decorative objects.
- Share memory boxes with nearby users.
- Synchronize memories through Apple iCloud and CloudKit.
Some features require an internet connection, an Apple account, iCloud access, camera access, microphone access, or location access.
2. Eligibility and Apple Sign-In
You must provide accurate information when using Memories.
Memories may allow you to sign in using Sign in with Apple. Your use of Sign in with Apple is also subject to Apple’s terms and conditions.
You are responsible for maintaining the security of your device and Apple account.
3. User content
You retain ownership of the photos, recordings, text, stories, and other content that you submit to Memories (“User Content”).
By submitting User Content, you grant us a limited, worldwide, non-exclusive license to host, process, reproduce, transmit, and display that content only as necessary to:
- Provide and improve the Memories service.
- Generate 3D models and related results.
- Store and synchronize your memories.
- Display your memories within the App.
- Complete sharing actions requested by you.
- Provide customer support and troubleshoot technical issues.
You confirm that you have the necessary rights and permissions to submit the User Content.
You must not upload content that:
- Infringes another person’s copyright, trademark, privacy, or other rights.
- Contains unlawful, abusive, threatening, or harmful material.
- Contains malware or malicious code.
- You are not legally permitted to share or process.
4. AI-generated and 3D content
The 3D models, descriptions, tags, categorizations, and other results generated by Memories may be created with automated or artificial-intelligence-assisted services.
Generated results may be incomplete, inaccurate, or different from the original object. Memories does not guarantee that a generated model will be an exact replica of the captured object.
You remain responsible for reviewing generated content before saving, sharing, or relying on it.
5. Sharing
Memories may allow you to share memory boxes with nearby devices.
When you choose to share content, the selected memories, media, recordings, and related information may be transferred to the recipient device. You are responsible for choosing what you share and with whom you share it.
Do not share content unless you have permission to share it.
6. Subscriptions and in-app purchases
Memories may offer free and paid features through Memories Premium.
Premium subscriptions may include:
- More or unlimited object creation.
- Access to complete 3D memories.
- Additional storage or premium functionality.
Subscriptions are purchased through Apple’s App Store. Payment is charged to your Apple ID account.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your Apple App Store account settings.
Any free trial, price, renewal period, and applicable taxes will be shown before purchase. A free trial automatically converts into a paid subscription unless cancelled before the trial ends.
Refunds are handled by Apple according to Apple’s refund policies.
7. Intellectual property
Memories, including its software, design, visual identity, text, graphics, animations, and functionality, is owned by or licensed to us and is protected by applicable intellectual-property laws.
These Terms do not transfer ownership of the App or any of its materials to you.
8. Third-party services
Memories may rely on third-party services, including Apple, iCloud, CloudKit, RevenueCat, AI providers, 3D-generation providers, and music or content search services.
Your use of third-party services may be subject to their own terms and privacy policies. We are not responsible for the availability, content, or policies of third-party services.
9. Availability and changes
We may modify, suspend, or discontinue parts of Memories at any time, including temporarily for maintenance, updates, security reasons, or technical limitations.
We do not guarantee that the App will always be available, error-free, or compatible with every device.
10. Disclaimer
Memories is provided on an “as available” and “as is” basis.
To the maximum extent permitted by law, we disclaim warranties relating to accuracy, availability, reliability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by applicable law, Memories and its operator will not be liable for indirect, incidental, special, consequential, or exemplary damages arising from your use of the App.
Nothing in these Terms limits liability that cannot legally be limited under applicable law.
12. Termination
You may stop using Memories at any time.
We may suspend or terminate access if you violate these Terms, misuse the App, or create a security or legal risk.
Upon termination, provisions that by their nature should continue will remain effective, including intellectual-property rights, disclaimers, limitations of liability, and dispute provisions.
13. Changes to these Terms
We may update these Terms from time to time. The updated version will be published with a new “Last updated” date.
Your continued use of Memories after an update means that you accept the revised Terms.
