General Provisions:

1.  These Terms of Use (the “Terms”) are a binding legal agreement between you (either an individual or an entity) and the Riyadh Municipality; the owner and the developer of the (مدينتي MyCity) application and it aims to provide you with the best experience in the easiest way to access the e-services of Riyadh Municipality. In order to save your time and effort, the application allows you to obtain various municipal services affiliated with Riyadh Municipality, in addition to inquiring about previous requests and filing reports.
2. Before using the (مدينتي MyCity) application, please read carefully these terms and the privacy policy.
3. The (مدينتي MyCity) application is offered to you subject to your acceptance of these terms and the privacy policy.
4. By accessing or using the (Madinaty) application in any manner, or obtaining any service or information on or through the (مدينتي MyCity) application, you acknowledge that you have read, understood, and agree to be bound by these terms and the privacy policy.
5. If at any time you do not agree to these terms, please immediately terminate your use of the (مدينتي MyCity) application.
6. The expression application mentioned herein refers to the (مدينتي MyCity) application.

Eligibility:

In order to use the (مدينتي MyCity) application, you must be the age of majority in your jurisdiction and fully able and competent to enter into the terms, conditions, and obligations, set forth in these Terms and to abide by and comply with these Terms. In any case, you affirm that you are over the age of 12, as the (مدينتي MyCity) is not intended for children under 12. If you are using or opening an account on the (مدينتي MyCity) on behalf of a company, entity, or organization, then you represent and warrant that you are an authorized representative of that entity with the authority to bind such entity to these Terms, and agree to be bound by these Terms on behalf of such entity.

Account Registration:

1.  (مدينتي MyCity) may include functionality that allows you to register an account on the application. When registering, you must provide accurate and complete information about yourself, including a valid email address.
2. Promptly update this information if it changes.
3. You are responsible for all activities associated with your account.
4. To protect your account from unauthorized use, keep your login information secure.
5. Please notify (مدينتي MyCity) application immediately of any unauthorized use of your account or any other breach of security.

(مدينتي MyCity) Terms of use:
User of (مدينتي MyCity) should not:

1. use the application for any commercial purpose (including without limitation for comparative or competitive commercial research purposes) unless expressly authorized by (مدينتي MyCity).
2. sell, resell, distribute, lease, or rent your access to the application or any information therein.
3. remove, circumvent, disable, damage, or otherwise interfere with any security-related features or measures employed to prevent or limit access or enforce limitations on the use of the application or any content therein.
4. interfere with or disrupt the application or related networks or servers or take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure.
5. create a false identity on the application.
6. use the application in any manner whatsoever that could lead to a violation of any Saudi Arabia or foreign, national, or local, laws, rules, or regulations.

User Content:

The (مدينتي MyCity) application may currently or may in the future allow you and other users to submit, post, and share content such as reviews, ratings, commentary, or any other content (“User Content”). You retain all your rights in your User Content.

Personal Information:

We collect registered information from the name, mobile number, and email of the user, when using our app. ( مدينتي MyCity), where the following are used:

1. The name in order to match the user's name with its licenses.
2. Mobile number for receiving SMS text messages.
3. E-mail in order to receive notifications of user requests.

Information collected during the use of the application

While using our application, and in order to provide the features of our application, we may collect, after obtaining your prior permission:

1- Photos and other information from your device's camera and photo library for use in attaching reports that assist in submitting requests for electronic services while maintaining the confidentiality of the information

2- Sending notifications and alerts regarding the status of requests

3- Accessing the calendar to save appointments created from the application

4- Accessing location services so that they can be used to locate 940 reports

5-Permanent access to precise location services to support the use of the 15-minute indicator service to be informed of service providers in the vicinity of your location

We use this information to provide the features of our service, and to improve and customize our service. The information may be uploaded to the company's servers and/or the service provider's server or may simply be stored on your device.

You can enable or disable access to this information at any time, through your device settings.

Your location information:

We collect information about your location when using our application (MyCityمدينتي), which helps us to know if your location is within the scope of our specific locations (centers and branches) to record your attendance.

Your location can be determined with varying degrees of accuracy by:

1. GPS
2. IP address
3. Sensor data from your device
4. Information about things near your device, such as Wi-Fi access points, cell towers, and Bluetooth-enabled devices

The types of location data we collect depend in part on your device and account settings. For example, you can turn your Android device’s location on or off using the device’s settings app. 

National Identity Authentication data (Nafath)

By using the (تطبيق مدينتي MyCity) app., the user agrees to provide the log in data for his National Identity Authentication data including the username and password used in Absher through Nafath portal, in order to be able to benefit from (تطبيق مدينتي MyCity) services.

Terms of user content:

(MyCityمدينتي) user must agree not to post, upload or otherwise disseminate through the application any of the following:

1. Any false or deceptive comments.
2. Advertisements of goods or notions.
3. Solicitations of business.
4. solicitations of any “shill” or otherwise financially motivated reviews or content.
5. write, transmit, display, or publish any content containing harmful information or images or abuse of individuals or entities inside or outside the Kingdom.
6. Content that violates, or that causes us or any of our affiliates, or other suppliers to violate, any applicable law, rule, or regulation of any governmental authority inside or outside Saudi Arabia.
7. Content that infringes or violates, or that may infringe or violate, any intellectual or proprietary right of any party, or that you otherwise do not have the right to make available.
8. Private or confidential information of any other person or entity without that person’s or entity’s authorization.
9. material that contains viruses or any other harmful software components.

User content usage:

If you provide User Content on or through the (MyCityمدينتي) or via email to us, including any feedback about the application, that means:

1.  You grant us and our affiliates, partners, and suppliers transferable right to use your User Content in any manner and for any purpose.
2. You agree that you own your User Content, and you have the necessary rights, approval, and permissions of use. Hence, the (MyCityمدينتي) has the right to use your User Content.
3. You have not posted any User Content in violation of these Terms.
4. We take no responsibility and assume no liability for any User Content posted, stored, or uploaded by you or any third party.
5. We take no responsibility and assume no liability for any loss or damage to any of that User Content.
6. (Madinaty) does not have any obligation to pre-screen or monitor User Content for any purpose.
7. (MyCityمدينتي) may choose, in its sole discretion, to monitor, review, or otherwise access some or all User Content, but by doing so, does not assume any additional obligations or responsibility.
8. You acknowledge and agree that (MyCityمدينتي) may, at any time and without prior notice, remove or modify any User Content for any reason, without any liability to you.

Ownership; Proprietary Rights of (MyCityمدينتي):

1. The (MyCityمدينتي) is owned and operated by or on behalf of the Riyadh Municipality.
2. The visual interfaces, graphics, design, compilation, information, content, computer code, software, services, and all other elements of the (MyCityمدينتي) application, and all intellectual property and proprietary rights therein, are owned solely by Riyadh Municipality or its future licensors.
3. All trademarks, service marks, and trade names are proprietary to Riyadh Municipality, the owner of the (MyCityمدينتي).
4. Use of any third-party trademarks on the (MyCityمدينتي) application does not indicate any endorsement by or affiliation with any such third party.
5. Nothing herein shall be interpreted to grant you any right or license under any intellectual property rights of (MyCityمدينتي) or any of its affiliates, partners, suppliers, whether for free or for a certain amount of money.

Third-Party Websites & Advertisements

(MyCityمدينتي) application may contain links to websites of third parties as a service to those interested in this information. Therefore, we would like to confirm that:

1. (MyCityمدينتي) application does not monitor or endorse any such websites and can make no guarantee as to their accuracy or completeness
2. You should review the applicable terms and policies, including privacy and data collection practices of any third-party websites accessible through this application.
3. Any terms, conditions, warranties, or representations associated with such advertisements or any products or services provided by third-party advertisers to you are solely between you and such third party.

Termination: 

1-By the Madinaty

Riyadh Municipality, in its sole discretion, may take the following actions: 

1. Terminate your account or disable your access to the application (or any part thereof) for any reason or no reason.
2. Discontinue the application and any related services, or terminate any license or permission granted to you hereunder, at any time, with or without notice
3. The application may terminate your account in cases of actual or suspected fraud or violation of the applicable Terms.
4. The Riyadh Municipality (the owner of MyCityمدينتي) may terminate your account in cases of actual or suspected fraud, or for a violation of these Terms and any suspected fraudulent, abusive, or illegal activity may be referred to appropriate law enforcement authorities.

Please be notified that (MyCityمدينتي) application shall not be liable to you or any third-party for any such termination. Without limiting the generality of the foregoing.

2- by you: 
If you are dissatisfied with the (MyCityمدينتي) application, then please let us know by contacting the application officials, so that we can improve it to meet the users’ needs. Your remedy with respect to any dissatisfaction with the application is to discontinue your use.

DISCLAIMERS:

You understand that when using the Madinaty application, you may be exposed to user content and third-party content that is illegal, inaccurate, or objectionable. You agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against the application with respect to any such content.

Third-party content: 

1. Most applications use remarketing to advertise on the internet based on someone's past visits to the application.
2. Most applications report how their ad impressions, other uses of ad services, and interactions with these ad impressions and ad services are related to visits to their application. this data is taken from Google's Interest-based advertising or 3rd-party audience data (such as age, gender, and interests).

(MyCityمدينتي) application is not responsible for all these advertisements, as the application user may choose not to watch them. The user has the right to change the Google-ads settings.

Notice:

(MyCityمدينتي) application may provide users with other services of the Riyadh Municipality (the application owner), this requires sending notices to users as follows: 

1. (MyCityمدينتي application) may provide you with notices by electronic mail, regular mail, or postings on the application.
2. If notice is provided by electronic mail, notice will be deemed given twenty-four hours after electronic mail is sent, unless the application is notified that the electronic mail address is invalid or has been changed.
3. If notice is provided by posting through the application, then a notice will be deemed given upon such posting.
4. (MyCityمدينتي) application may give you legal notice by mail to a postal address if provided by you through the application. In such case, notice will be deemed given three days after the date of mailing.
