MatchIQ Terms and Conditions

Effective Date: July 1, 2026

These Terms and Conditions ("Terms") govern your access to and use of MatchIQ, including our mobile application, services, features, AI-generated outputs, subscriptions, and related content (collectively, the "Service").

By downloading, accessing, purchasing, or using MatchIQ, you agree to these Terms. If you do not agree, do not use the Service.

1. Who We Are

MatchIQ is operated by Bryan Gonzalez ("MatchIQ," "we," "us," or "our").

2. Entertainment Purposes Only

MatchIQ is a lighthearted entertainment app that provides AI-generated photo feedback, match probability scores, and related insights.

The Service is intended for entertainment, curiosity, self-reflection, and social fun. MatchIQ does not provide medical, psychological, biometric identification, legal, financial, dating, relationship, or professional advice.

AI-generated results are automated, probabilistic, and may be inaccurate, incomplete, subjective, offensive, unexpected, or unsuitable for your situation. You should not rely on MatchIQ outputs as objective truth or as the basis for important personal, romantic, financial, legal, employment, health, or safety decisions.

3. Age Requirement

You must be at least 18 years old to use MatchIQ.

You may not use the Service if you are under 18. You may not upload, submit, analyze, compare, or otherwise process photos of anyone under 18, including yourself if you are under 18.

By using MatchIQ, you represent and warrant that:

• You are at least 18 years old.
• You will not upload photos of minors, including old photos of yourself taken before you turned 18.
• You have the legal capacity to agree to these Terms.

We use automated age-estimation screening on uploaded photos in addition to these representations. Photos flagged as potentially depicting a minor will be rejected and may result in account review or suspension. This screening is a safeguard, not a guarantee — you remain solely responsible for the content you upload.

We may suspend or terminate accounts that we believe violate this age requirement, and may report suspected child exploitation material to the National Center for Missing & Exploited Children (NCMEC) or other relevant authorities as required by law.

4. User Photos and Consent

MatchIQ allows users to upload or submit photos for AI-powered analysis.

You are solely responsible for any photo or content you upload, submit, or provide through the Service.

By uploading a photo, you represent and warrant that:

• You own the photo or have the legal right to upload and use it.
• You have obtained all necessary permissions and consents from any identifiable person shown in the photo, including their consent to have their likeness analyzed by AI and scored.
• The photo does not depict anyone under 18.
• The photo does not violate any person's privacy, publicity rights, intellectual property rights, or other legal rights.
• The photo does not violate any law, regulation, platform rule, or these Terms.

You must not upload photos of another person without their permission. You must not upload photos obtained by stalking, harassment, scraping, impersonation, deception, breach of confidence, or unauthorized access.

Rights of photographed individuals. If you are not a MatchIQ user but believe your photo has been uploaded without your consent, you may request its removal by contacting matchiqapp@gmail.com with reasonably sufficient identifying detail. We will review and remove verified unauthorized content and may suspend the uploading account.

5. Prohibited Content

You may not upload, submit, create, request, or use the Service to process content that:

• Depicts or involves anyone under 18.
• Contains nudity, sexual content, intimate images, or non-consensual sexual material.
• Contains exploitative, abusive, harassing, threatening, hateful, defamatory, or degrading material.
• Invades another person's privacy.
• Violates another person's intellectual property, publicity, or personality rights.
• Was obtained without permission.
• Promotes self-harm, eating disorders, abuse, harassment, discrimination, or violence.
• Attempts to identify, dox, stalk, or target another person.
• Attempts to bypass security, payment, usage limits, or technical restrictions.
• Violates any applicable law or regulation.

We may remove content, restrict access, suspend accounts, or terminate users at our discretion if we believe these Terms have been violated.

6. AI Results and Match Probability Scores

MatchIQ may generate ratings, match probability scores, compatibility-style insights, feedback, summaries, or other outputs using automated AI systems.

You understand and agree that:

• AI outputs are for entertainment only.
• AI outputs are not objective or definitive assessments.
• AI outputs may be wrong, inconsistent, biased, incomplete, or misleading.
• Match probability scores do not predict real-world romantic outcomes.
• MatchIQ does not guarantee attraction, compatibility, dating success, relationship success, or any real-world result.
• MatchIQ does not determine anyone's worth, identity, character, health, beauty, desirability, or social value.

You are responsible for how you interpret and use any output.

7. Biometric Data and No Identification

Generating match scores may involve automated processing of facial geometry or other visual characteristics from your uploaded photos ("biometric-adjacent processing"). This processing is used only to generate entertainment-oriented scores and outputs within the Service.

MatchIQ is not intended to identify people, verify identity, authenticate users by face, determine legal identity, or create persistent biometric identification profiles. You may not use MatchIQ for surveillance, identification, authentication, law enforcement, employment screening, housing decisions, insurance decisions, credit decisions, or any other high-impact decision.

Consent to biometric-adjacent processing. By uploading a photo, you consent to MatchIQ's automated processing of that photo's visual characteristics as described above, for as long as reasonably necessary to provide the Service, subject to our Privacy Policy's retention and deletion terms. If you are a resident of a jurisdiction with specific biometric privacy laws (e.g., Illinois, Texas, Washington), our Privacy Policy contains additional disclosures applicable to you.

8. Account Registration and Security

You may need an account to use certain features. You agree to provide accurate information and to keep your account credentials secure.

You are responsible for all activity under your account. You must notify us if you believe your account has been compromised.

We may suspend or terminate your account if we believe your account has been used in violation of these Terms.

9. Subscriptions, Purchases, and Billing

MatchIQ may offer paid subscriptions, including MatchIQ Premium, through Apple In-App Purchase.

Subscriptions may automatically renew unless cancelled according to Apple's subscription terms and settings. Payment is charged through your Apple ID or App Store account. MatchIQ does not directly collect or store your full payment card information.

You are responsible for managing or cancelling your subscription through your Apple account settings. Deleting the app does not automatically cancel your subscription.

Refunds, billing issues, and cancellations may be handled by Apple according to Apple's policies.

Premium features, scan limits, usage allowances, and included functionality may change over time, subject to applicable law and platform requirements.

10. Usage Limits and Fair Use

MatchIQ may impose usage limits, scan limits, rate limits, file size limits, image type restrictions, or other technical restrictions to protect the Service, manage costs, prevent abuse, and ensure fair access.

We may limit, throttle, suspend, or block usage if we believe an account or device is abusing the Service, attempting to bypass limits, creating excessive load, violating these Terms, or threatening the stability or security of the Service.

Cached or repeated results may be returned without reprocessing. Fresh AI scans may count differently than repeated or cached scans.

11. Privacy and Data Retention

Your use of MatchIQ is also governed by our Privacy Policy.

The Privacy Policy explains what information we collect, how we use it, how long we retain uploaded photos and derived data, how you can request deletion of your photos and account data, and how third-party service providers may process information on our behalf.

By using the Service, you acknowledge that photos, account information, usage data, subscription status, and related inputs may be processed to provide the Service, enforce limits, manage subscriptions, prevent abuse, and operate MatchIQ.

Model training. We do not use your uploaded photos to train or fine-tune AI models unless we obtain your separate, explicit opt-in consent to do so. Details are in our Privacy Policy.

12. Third-Party Services

MatchIQ relies on third-party service providers for authentication, hosting, database services, subscriptions, payments, analytics, diagnostics, AI processing, and other functionality.

These providers may include services such as Apple, Google, Supabase, RevenueCat, Render, one or more AI model providers, or other providers we use to operate the Service.

We are not responsible for third-party services, outages, policies, terms, errors, or actions. Your use of third-party services may be subject to their own terms and privacy policies.

13. License to User Content

You retain ownership of photos and content you submit, subject to the rights you grant us.

By uploading, submitting, or providing content to MatchIQ, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, reproduce, analyze, transform, cache, and display that content solely as reasonably necessary to:

• Provide the Service.
• Generate AI outputs.
• Return results to you.
• Enforce usage limits.
• Maintain security.
• Debug and improve reliability.
• Comply with legal obligations.
• Protect the Service from abuse.

This license does not give us ownership of your content, and does not include a right to use your content to train AI models absent your separate opt-in consent per Section 11.

14. Intellectual Property

MatchIQ, including its software, design, user interface, branding, models, prompts, workflows, systems, logos, features, and related technology, is owned by us or our licensors.

You may not copy, modify, reverse engineer, scrape, resell, sublicense, exploit, or create derivative works from MatchIQ except as permitted by law or with our written permission.

15. Acceptable Use

You agree not to:

• Use the Service unlawfully.
• Upload content without required consent.
• Upload photos of minors.
• Harass, shame, threaten, exploit, or target others.
• Use outputs to discriminate, defame, bully, or harm others.
• Attempt to identify or surveil people.
• Circumvent subscriptions, usage limits, authentication, security, or access controls.
• Interfere with the Service or overload our systems.
• Use bots, scripts, automation, or scraping without permission.
• Reverse engineer or extract prompts, systems, or models.
• Use the Service to develop a competing product.
• Misrepresent AI outputs as objective truth.

16. Account Suspension and Termination

We may suspend, restrict, or terminate your access to MatchIQ at any time if we believe you have violated these Terms, created risk for us or others, abused the Service, failed to pay for paid features, or used the Service unlawfully.

You may stop using MatchIQ at any time. Subscription cancellation must be handled through your Apple account settings where applicable.

17. Disclaimers

The Service is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, reliability, availability, fitness for a particular purpose, merchantability, non-infringement, and uninterrupted operation.

We do not warrant that:

• The Service will always be available.
• AI outputs will be accurate.
• Scores or feedback will be consistent.
• The Service will meet your expectations.
• The Service will be free of bugs, delays, errors, or interruptions.
• Any result will produce a real-world outcome.

18. Limitation of Liability

To the fullest extent permitted by law, MatchIQ and its operators, owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, exemplary, or similar damages, including lost profits, lost data, emotional distress, reputational harm, relationship issues, personal decisions, or damages arising from your use of or reliance on the Service.

To the fullest extent permitted by law, our total liability for any claim related to the Service will not exceed the amount you paid to MatchIQ in the three months before the claim arose, or CAD $50, whichever is greater.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

19. Indemnification

You agree to defend, indemnify, and hold harmless MatchIQ and its operators, owners, employees, contractors, service providers, and affiliates from any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to:

• Your use of the Service.
• Your uploaded content.
• Your violation of these Terms.
• Your violation of another person's rights.
• Your failure to obtain required consent.
• Your misuse of AI outputs.
• Your violation of law or platform rules.

20. Changes to the Service

We may modify, suspend, discontinue, limit, or update the Service or any feature at any time. We may change pricing, usage limits, included features, AI models, workflows, or availability, subject to applicable law and platform requirements.

21. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the app, website, App Store listing, email, or other appropriate means.

Your continued use of MatchIQ after updated Terms become effective means you accept the updated Terms.

22. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Alberta and the laws of Canada applicable therein, without regard to conflict of law principles.

Subject to applicable consumer protection laws, disputes will be handled in the courts located in Alberta, Canada. Nothing in this section limits any non-waivable rights you may have under the mandatory consumer protection laws of your jurisdiction of residence.

23. Miscellaneous

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and MatchIQ regarding the Service.

No waiver. Our failure to enforce any provision is not a waiver of that provision.

Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.

24. Apple App Store Terms

If you download or purchase MatchIQ through the Apple App Store, Apple's applicable terms, rules, and policies also apply. Apple is not responsible for providing support or maintenance for MatchIQ except as required by applicable law.

In the event of a conflict between these Terms and Apple's applicable terms, Apple's terms may control to the extent required for App Store distribution.
