These Privacy Policy & Terms of Use ("Terms") apply to the Market Predictor mobile application, together with any related services (collectively, the "Application"), operated by Market Predictor ("Service Provider", "we", "us"). By downloading, accessing, or using the Application, you agree to these Terms. If you do not agree, do not use the Application.

PART 1 — TERMS OF USE

1. Not Financial Advice
The Application provides algorithmically-generated price predictions, technical indicators, and market commentary for stocks and cryptocurrencies, provided for informational and educational purposes only.
Nothing in the Application constitutes financial, investment, legal, or tax advice, or a recommendation to buy, sell, or hold any security or asset. The Service Provider is not a registered investment advisor, broker-dealer, or financial institution. Predictions are not guaranteed to be accurate and past performance is not indicative of future results.
Terminology used in the Application — including but not limited to "verdict," "confidence score," "bullish," "bearish," and "pattern detected" — describes the output of an automated technical-analysis algorithm applied to historical price data. Such terminology is descriptive only, does not constitute a trading signal, forecast guarantee, or recommendation of any kind, and should not be relied upon or interpreted as such.
You are solely responsible for your own investment decisions. Never invest money you cannot afford to lose. Consult a licensed financial advisor before making investment decisions.
2. License to Use the Application
Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a mobile device for personal use. You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application, or attempt to extract, misuse, or reverse-engineer any API keys, credentials, or backend infrastructure used by the Application, except as and only to the extent expressly permitted by applicable law.
3. Intellectual Property
The Service Provider retains all intellectual property rights in the Application, including its code, design, trademarks, and branding. Nothing in these Terms grants you any license to use the Service Provider's trademarks, logos, or branding for any purpose.
4. Subscription — Market Predictor Premium
The Application offers an optional auto-renewing subscription ("Premium") that unlocks additional features, including the Watchlist, Portfolio Tracker, AI chat assistant, and extended stock chart periods and scenario analysis.
- Price: $1.99 USD/month (may vary by region, shown in local currency at checkout via Google Play).
- Billing: Charged at purchase confirmation, and auto-renews monthly unless turned off at least 24 hours before the current period ends.
- Free features: Crypto and basic stock predictions (1-day, 5-day, and 1-month full access) remain available without a subscription.
- Management & cancellation: Billed and managed entirely through Google Play (Play Store app → Menu → Payments & subscriptions). The Service Provider does not process payments directly and cannot cancel or refund a subscription on your behalf.
- Refunds: Subject to Google Play's refund policies, not the Service Provider's.
- No proration: Cancelling retains Premium access until the end of the current paid billing period; no partial refunds are issued for unused time.
5. Third-Party Services
The Application relies on the following third-party services:
- Kraken — supplies live cryptocurrency market data via its public API. No personal data is sent to Kraken.
- Twelve Data — supplies live stock market data. No personal data is sent to Twelve Data.
- Supabase — hosts backend infrastructure and stores Price Alert data (see Privacy Policy, Part 2).
- Google Play Services / Google Play Billing — provides app distribution and processes Premium subscription payments.
The Service Provider does not control and is not responsible for the accuracy, timeliness, or completeness of data provided by these third parties. Prices and data displayed in the Application may be delayed and may differ from live exchange values. The Service Provider accepts no liability for loss resulting from reliance on third-party data or from inaccuracies in it.
6. Acceptable Use
You agree not to: (a) use the Application for any unlawful purpose; (b) reverse-engineer, extract, or misuse any API keys, credentials, or backend infrastructure used by the Application; (c) use bots or scrapers to access the Application beyond normal use; or (d) interfere with the Application's operation or other users' access to it.
7. Connectivity & Device Responsibility
Some functions of the Application require an active internet connection (Wi-Fi or mobile data). The Service Provider is not responsible if the Application does not function at full capacity due to lack of connectivity, exhausted data allowances, or a depleted device battery. If you use the Application outside a Wi-Fi area, your mobile carrier's data charges (including roaming) may apply, and you accept responsibility for these.
8. Disclaimer of Warranties
The Application is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to accuracy, reliability, availability, or fitness for a particular purpose. The Service Provider does not guarantee the Application will be uninterrupted, error-free, or free of inaccurate predictions.
9. Limitation of Liability
To the fullest extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, including any financial losses resulting from decisions made based on predictions, analysis, or data shown in the Application.
However, the Service Provider retains full liability for: death or personal injury caused by its negligence; fraud or fraudulent misrepresentation; and any other liability that cannot be excluded or limited under applicable law.
To the fullest extent permitted by law, the Service Provider's total liability for any claim shall not exceed the amount you paid for the Application in the 12 months preceding the claim, or the minimum amount required by applicable law, whichever is greater. If the Application is used free of charge, liability is limited to the minimum amount permitted by applicable law.
Nothing in these Terms limits any rights you have under applicable consumer protection law that cannot be lawfully excluded.
10. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless the Service Provider from claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your breach of these Terms or intentional misuse of the Application. This does not apply to claims arising from the Service Provider's own negligence or breach of these Terms.
11. Artificial Intelligence
The Application incorporates AI technologies to provide certain features, including predictions and an AI chat assistant. By using the Application, you acknowledge that AI may be used to process data and deliver these functionalities, in compliance with applicable law.
12. Updates & Termination
The Service Provider may update the Application periodically; continuing to use it after an update requires you to accept the current version. The Service Provider may suspend or terminate your access for a material breach of these Terms (with 14 days' notice and opportunity to cure, where the breach is curable), or immediately without notice for illegal activity, IP infringement, or harm to other users. The Service Provider may also cease providing the Application at any time. Upon termination, you must stop using the Application and delete it from your device.
13. Eligibility
You must be at least 13 years of age (or the age of digital consent in your jurisdiction) to use the Application. If you are below this age, a parent or legal guardian must review and accept these Terms on your behalf.
14. Governing Law
These Terms are governed by the laws of the jurisdiction in which the Service Provider operates, without regard to conflict of law principles, except where superseded by applicable local consumer protection law. Nothing in this clause limits any right you have to bring a claim in a court competent under mandatory law.
15. Severability & Entire Agreement
If any provision of these Terms is held invalid or unenforceable, it will be modified to the minimum extent necessary to be enforceable, and the remaining provisions remain in full force. These Terms, together with the Privacy Policy below, constitute the entire agreement between you and the Service Provider.
16. Changes to These Terms
The Service Provider may update these Terms from time to time. Material changes will be reflected by an updated effective date. Continued use of the Application after changes take effect constitutes acceptance.

PART 2 — PRIVACY POLICY

Information Collection and Use
Collected automatically on use: your device's IP address; pages visited and time/date of visit; time spent in the Application; and your mobile operating system.
If you set up a Price Alert, we additionally collect and store your email address, the asset symbol, your target price, and alert direction, in order to notify you by email when your target price is reached. This data is stored on our backend, provided by Supabase, and is retained until you delete the alert or request deletion of your data.
If you subscribe to Market Predictor Premium, your payment is processed entirely by Google Play Billing. The Service Provider does not receive or store your payment card details — only confirmation of an active subscription.
Third-Party Services We Use
- Kraken — live cryptocurrency market data (public API; no personal data sent).
- Twelve Data — live stock market data (no personal data sent).
- Supabase — backend hosting; stores Price Alert data (email, target price, symbol, direction).
- Google Play Services / Google Play Billing — app distribution and subscription payment processing. See Google's Privacy Policy (https://policies.google.com/privacy) for how Google handles data on its platform.
Communications
The Service Provider may use the information you provide to send important information, required notices, and, where permitted by law, marketing communications.
Cookies and Tracking Technologies
The Application or its third-party SDKs may use cookies, SDKs, pixels, and similar technologies to support functionality, analytics, or service delivery. Consent is obtained before non-essential tracking where required by law.
Your Rights
Request access, correction, or deletion of your personal data (including Price Alert data held via Supabase), or withdraw consent, by contacting dennyjunk316@gmail.com.
Your California Privacy Rights (CCPA/CPRA)
California residents have the right to know what personal information is collected, request deletion, opt out of sale/sharing, and exercise these rights without discrimination. Contact the email above to exercise these rights.
Artificial Intelligence
The Application uses AI to enhance user experience and deliver certain features, which may process user data for personalized content or automated functionality, in accordance with this policy and applicable law.
Third Party Access
Beyond the services named above, only aggregated, anonymized data is periodically shared with external services to help improve the Application. Information may otherwise be disclosed: as required by law (e.g. subpoena); when necessary in good faith to protect rights or safety, investigate fraud, or respond to a government request; or with trusted service providers bound by this policy.
International Data Transfers
Personal data may be transferred outside your country of residence, including outside the European Economic Area (EEA). Where required, appropriate safeguards are used (Standard Contractual Clauses, adequacy decisions, or your consent).
Opt-Out & Deletion
Uninstalling the Application stops further data collection but does not delete data already transmitted. To request deletion of your data or exercise any rights, contact dennyjunk316@gmail.com.
Data Retention
- User-provided data: retained for the duration of your use plus 12 months.
- Automatically collected data: retained up to 24 months.
- Aggregated/anonymized data: retained indefinitely.
- Data required for legal compliance: retained as long as required.
Children
The Application is not intended for children under 13 (or such higher age as required by applicable law). The Service Provider does not knowingly collect personal data from children in violation of applicable law, and will delete any such data discovered, upon notice at dennyjunk316@gmail.com.
Security
The Service Provider maintains physical, electronic, and procedural safeguards to protect the confidentiality of the information it processes and maintains.
Data Breach Notification
If a data breach affecting your personal data occurs, the Service Provider will notify you in accordance with applicable legal requirements.
Your Consent
Where processing is based on consent, you provide it by affirmatively opting in to the relevant feature (e.g. setting a Price Alert). You may withdraw consent at any time without affecting processing already carried out.
Changes to This Policy
The Service Provider may update this Privacy Policy & Terms of Use from time to time. Material changes will be reflected with an updated effective date, and, where required by law, your renewed consent will be sought. Previous versions are available upon request.
