TERMS AND CONDITIONS

These Terms and Conditions apply to the Journi mobile application (hereinafter referred to as the “Application”), developed and operated by Seweryn Lasko (hereinafter referred to as the “Service Provider”) as a commercial service. By downloading, installing, or using the Application, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you must discontinue use of the Application immediately.
1. Intellectual Property Rights
The Application, including but not limited to its source code, design, trademarks, logos, databases, and content, is the exclusive property of the Service Provider. You may not copy, modify, distribute, reverse engineer, decompile, extract the source code, translate, or create derivative works of the Application or any part thereof. All intellectual property rights related to the Application remain with the Service Provider.
2. Modifications to the Application
The Service Provider reserves the right to modify, update, suspend, or discontinue the Application or any part of its functionality at any time and for any reason, with or without notice. The Service Provider does not guarantee that the Application will always be available, uninterrupted, error-free, up-to-date, or compatible with all devices or operating system versions.
3. Paid Features and Purchases
The Application may offer paid features, including but not limited to unlocking additional functionality beyond free usage limits (“Premium Features”).
All payments made for Premium Features are final and non-refundable, to the maximum extent permitted by applicable law. Once a purchase is completed, no refunds, credits, or exchanges will be provided, including in cases where the Application is modified, discontinued, or becomes unavailable.
The User acknowledges that purchases are made voluntarily and at their own risk.
4. No Guarantee of Availability
The Service Provider does not guarantee that the Application or any of its features will be available for any specific period of time.
Access to the Application, including Premium Features, may be terminated at any time without obligation to provide refunds, compensation, or continued access.
5. User Responsibilities
The Application stores and processes personal data provided by the User in order to deliver its services.
You are responsible for maintaining the security of your device and access to the Application. Jailbreaking or rooting your device is strongly discouraged, as it may compromise security and cause the Application to malfunction or become unusable.
6. Third-Party Services
The Application uses third-party services that are subject to their own Terms and Conditions and Privacy Policies, including but not limited to:
• Google Play Services
• Expo
• Sentry
• Mapbox
The Service Provider is not responsible for the practices, availability, or content of third-party services.
7. Internet Connectivity and Charges
Certain features of the Application require an active internet connection. The Service Provider is not responsible for reduced functionality due to lack of connectivity, data limits, or network issues.
You are solely responsible for any data charges, roaming fees, or other costs incurred through your mobile network provider while using the Application. If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.
Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.
8. Limitation of Liability
The Application is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, the Service Provider shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to your use of or inability to use the Application, including but not limited to loss of data, loss of access, or loss of paid features.
The Service Provider accepts no liability for any losses (direct or indirect) resulting from reliance on information provided through the Application.
9. Updates and Termination
The Service Provider may update the Application from time to time. You agree to accept updates when they are made available.
The Service Provider may cease providing the Application and terminate its use at any time without prior notice. Upon termination, all rights granted to you under these Terms will immediately cease, and (if necessary) you must stop using and delete the Application from your device.
10. Changes to These Terms and Conditions
The Service Provider reserves the right to modify these Terms and Conditions at any time.
Continued use of the Application after changes become effective constitutes acceptance of the revised Terms. Users are encouraged to review these Terms periodically.
11. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the jurisdiction in which the Service Provider is registered, without regard to conflict of law principles.
