BackTracked – Terms of Service

Welcome to BackTracked. These Terms of Service (“Terms”) govern your access to and use of the BackTracked mobile application (“App”) and any related services provided by BackTracked (“we,” “us,” or “our”). By using the App, you agree to these Terms. If you do not agree, please discontinue use of the App.
1. Overview of the Service
BackTracked is a companion mobile application used with compatible BackTracked hardware devices. The App allows users to pair the hardware, view GPS location data, monitor weight sensor readings, and play pre-recorded audio clips from the device.
The App is intended for general informational and convenience purposes only and should not be relied upon as a sole safety or emergency system.
2. Eligibility
You must be at least 18 years old or have parental consent to use this App. If you are using the App on behalf of a minor, you are responsible for all activity that occurs under the minor’s usage.
3. User Responsibilities
You agree to:
Use the App and hardware only in lawful ways.
Not misuse or attempt to interfere with App features, hardware functionality, or system security.
Follow all applicable laws and regulations related to location tracking, privacy, and data collection when using the hardware on individuals or personal belongings.
You are responsible for ensuring that the hardware is placed and used in an appropriate and safe manner.
4. Hardware Disclaimer
BackTracked works in conjunction with third-party hardware components, including but not limited to the Particle Boron, GPS modules, weight sensors, and audio playback components. We do not guarantee the accuracy, responsiveness, or uninterrupted functionality of hardware components.
You acknowledge that:
GPS signals may be inaccurate or unavailable depending on environment or hardware placement.
Weight sensor readings may vary depending on calibration and usage.
Audio playback may not operate under certain environmental or hardware limitations.
We are not liable for hardware malfunctions, modifications, or damages caused by misuse.
5. No Emergency Services
BackTracked is not an emergency or life-saving device. It is not intended to replace supervision, communication, or safety procedures. Do not rely on BackTracked as your sole means of locating a person or valuable item.
6. App Updates and Changes
We may modify, update, or discontinue features at any time. Continued use of the App after changes are made constitutes acceptance of the updated Terms.
7. Account and Data Security
You are responsible for maintaining the confidentiality of any login information associated with the App. We are not responsible for unauthorized access caused by failure to secure your device or account credentials.
8. Limitation of Liability
To the fullest extent permitted by law:
We are not responsible for any damages arising from your use or inability to use the App or hardware.
We do not guarantee accuracy of data displayed through the App (including GPS data, sensor data, or audio playback).
Your use of the App is at your own risk.
9. Termination
We may suspend or terminate your access to the App at any time for violation of these Terms or misuse of the hardware or service.
10. Governing Law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles.

BackTracked – Privacy Policy

This Privacy Policy explains how BackTracked (“we,” “us,” or “our”) collects, uses, and protects your information when you use the BackTracked mobile application and companion hardware device. By using the App, you consent to the practices described in this Policy.

When you use the App with BackTracked hardware, GPS coordinates from the device may be transmitted to the App to display the device’s approximate location. This data is used solely for the purpose of providing location features within the App.
b. Sensor Data
The App may receive weight measurements or audio playback-related data from the hardware device.
c. Device and App Usage Data
We may collect diagnostic information such as crash logs, technical data, device type, and usage statistics to improve App performance.
d. User-Provided Information
If you contact us, we may store your email address and any information you voluntarily provide.
We do not collect children's personal information. The App does not require users to submit identifiable data about minors.
2. How We Use Information
We use the information collected to:
Display GPS location on the map within the App.
Provide sensor data readings from the hardware.
Play or manage audio clips sent to or stored on the device.
Improve and troubleshoot App performance.

3. Data Sharing
We may share non-identifiable, aggregated data for analytics or App improvement. We do not share personal information with third parties except:

4. Data Storage and Security
We implement reasonable safeguards to protect data transmitted between the hardware, App, and any backend services. However, no system can be guaranteed to be 100% secure.
You are responsible for securing your mobile device and any login credentials.
5. Location Data Disclosure
The App requires access to location data to function properly with the BackTracked hardware. Location data is only used to display device location and is not used for marketing, tracking unrelated to your device, or shared with third parties.
6. Children’s Privacy
BackTracked does not knowingly collect personal information from children. Parents and guardians are solely responsible for complying with any laws regarding tracking or monitoring minors using the hardware.
7. Your Choices
You may choose to:
Disable location permissions, though this will limit App functionality.
Stop using or unpairing the hardware device.
Uninstall the App at any time.
8. Changes to This Privacy Policy
We may update this Policy to reflect changes in technology or legal requirements. Continued use after updates indicates acceptance of the revised Policy.
