Terms and Conditions for BreatheMeter
These terms and conditions apply to the BreatheMeter app (hereby referred to as "Application") for mobile devices that was created by Nikhil Fuge (hereby referred to as "Service Provider") as a Free service with optional premium subscription features.
Agreement to Terms
Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. If you do not agree to these terms, please do not download or use the Application.
Intellectual Property Rights
Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.
You are granted a limited, non-exclusive, non-transferable license to download and use the Application on your personal device for your personal, non-commercial use only.
Modifications and Charges
The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.
Premium Subscription:
- Premium features are available through in-app subscription (Monthly or Yearly plans)
- Pricing is displayed before purchase and varies by region
- Subscriptions auto-renew unless canceled
- You can manage or cancel your subscription through iOS Settings → App Store → Subscriptions
- Refunds are handled according to Apple's App Store refund policy
Data and Account Security
The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application.
Your Responsibilities:
- Protect your Apple ID and password
- Maintain the confidentiality of your account information
- Ensure no unauthorized persons have access to your device
- Disable biometric locks if sharing your device with others
The Service Provider strongly advises against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could:
- Expose your phone to malware and viruses
- Compromise your phone's security features
- Cause the Application not to function correctly or at all
- Void any warranties on your device
Data Backup and Storage
Local Storage:
- All breathing measurements and personal data are stored locally on your device
- You are responsible for maintaining backups of your data
- If you delete the Application or clear app data, your local measurements will be lost
Cloud Backup (Premium Feature):
- Cloud backup and sync features may store your data on iCloud servers
- Cloud storage is optional and requires your explicit consent
- You can disable cloud sync or delete cloud data at any time
- The Service Provider is not responsible for data loss due to cloud service outages or Apple service disruptions
Data Export:
- You can export your data as CSV or PDF files through the Application
- Exported files are your responsibility to store and protect
- The Service Provider is not liable for loss of exported files
Internet Connection and Availability
Please be aware that some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider:
- Apple HealthKit sync requires internet connectivity
- Cloud backup and sync features require internet access
- Analytics and crash reporting may use data connection
The Service Provider cannot be held responsible if the Application does not function at full capacity due to:
- Lack of access to Wi-Fi
- Exhausted data allowance from your mobile provider
- Network connectivity issues
- Service interruptions from third parties (Apple, Google, etc.)
Mobile Network Provider Charges
If you are using the Application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during connection to the Application, or other third-party charges.
By using the Application, you accept responsibility for any such charges, including:
- Data usage charges
- Roaming data charges if you use the Application outside your home territory without disabling data roaming
- Any charges from Apple (for in-app purchases or subscriptions)
If you are not the bill payer for the device on which you are using the Application, you assume that you have obtained permission from the bill payer.
Device Maintenance and Battery
The Service Provider cannot assume responsibility for your device's maintenance. It is your responsibility to ensure that:
- Your device remains charged
- Your device has sufficient storage space
- Your device's operating system is up-to-date
- Your device meets minimum system requirements
If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.
Accuracy and Limitations of Information
The Application provides breathing rate measurements and statistics for general wellness purposes only. Please note:
- The Application is NOT a medical device and should not be used for medical diagnosis or treatment
- Measurements are estimates and may not be 100% accurate
- Results should not replace professional medical advice
- Always consult healthcare professionals for medical concerns
While the Service Provider strives to ensure that the Application is updated and accurate at all times, they rely on third parties to provide information (such as Apple HealthKit). The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on the functionality of the Application.
Health Disclaimer
Important: BreatheMeter is designed for general wellness and should not be used as a medical device. The Application:
- Is not intended to diagnose, treat, cure, or prevent any disease
- Should not replace professional medical advice
- Should not be used as a substitute for consultation with healthcare professionals
- May not be accurate for all users or all conditions
Always consult with a qualified healthcare professional before making any health-related decisions based on Application data.
Updates and Compatibility
The Service Provider may wish to update the Application at some point. The Application is currently available as per the requirements of the operating system. Operating system requirements and compatibility may change, and you will need to download updates if you want to continue using the Application.
The Service Provider does not guarantee that:
- It will always update the Application so that it is relevant to you
- It will maintain compatibility with your particular operating system version
- The Application will continue to be compatible with future iOS versions
- The Application will be supported indefinitely
You agree to always accept updates to the Application when offered to you. Updates may include:
- Bug fixes and performance improvements
- Security patches
- New features
- Compatibility improvements
Termination of Service
The Service Provider may cease providing the Application and may terminate its use at any time without providing termination notice to you. Upon any termination:
- The rights and licenses granted to you in these terms will end
- You must cease using the Application
- You should delete the Application from your device
- You may lose access to your data if stored in cloud services
For Premium Subscribers: If the Service Provider terminates the Application, remaining subscription fees will be refunded according to Apple's policies.
Limitation of Liability
To the fullest extent permitted by law, the Service Provider shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of data, revenue, or profits
- Interruption of service
- Third-party claims
- Any damages arising from use or inability to use the Application
- Health-related issues or injuries resulting from using the Application

The Application is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. The Service Provider disclaims all warranties including:
- Merchantability
- Fitness for a particular purpose

- Uninterrupted service

Third-Party Services
The Application uses third-party services:
- Apple HealthKit: Your use of HealthKit is governed by Apple's terms
- Firebase (Google Analytics): Analytics governed by Google's terms
- Apple App Store: In-app purchases and subscriptions governed by Apple's App Store terms
The Service Provider is not responsible for the conduct or policies of third-party services.
Changes to These Terms and Conditions
