TERMS AND CONDITIONS OF USE OF BENCH INSTANT REPLAY

1. General Information

Owner: Rubén Garabaya Arenas (hereinafter, the Owner).

Residence: Santander.

Application: Bench Instant Replay (hereinafter, the Application).

Description: The application allows instant replays of game actions in any sport on the bench.

2. Acceptance of the Terms and Conditions

Access and use of the Application implies full and unreserved acceptance of these Terms and Conditions.

Acceptance is made by checking a checkbox at the time of registration.

Use of the app implies full acceptance of these terms and conditions.

If the user does not agree with these Terms and Conditions, they should not use the Application.

3. How the App Works

Description: The App allows for instant replays of game action in any sport on the bench.

Specific Operation:

A user on a sending device makes cuts (capturing video fragments).

The cuts are automatically sent to the receiving device (on the bench).

The App saves the videos on the device.

Connection: The connection between the sender and receiver is 1 to 1, using the Nearby Connections API.

Internet: An internet connection is required for registration, login and activation. It is not required for normal operation.

Devices: The App requires Android devices (tablet recommended).

4. Limited Use and Registration

Limited Use: The App operates for free and without registration for a limited time.

Registration: After the limited time, the App closes. To continue using it, the user must register.

Registration Requirements: Registration requires an email and password.

Activation: After registration, the user must enter an activation code for unlimited use of the application.

Social networks: The application does not allow registration through social networks.

5. Activation Code

The Application requires an activation code for unlimited use after registration.

The Owner will personally manage the distribution of the activation codes.

6. Business Model

The Application is free to download.

Unlimited use requires an activation code managed by the Owner.

7. User Generated Content

Videos: The Application saves videos (clips) on the user\'s device.

Privacy: No public content is generated within the Application.

Use of Content: The Application does not use the videos outside of the Application itself.

Ownership: The generated videos are the property and responsibility of the user.

Sharing: The application does not share the content outside of the app.

8. Intellectual Property

The Owner is the owner of all intellectual and industrial property rights of the Application, including the source code, design, logos, and Bench Instant Replay brand.

The use of the Application does not grant the user any rights over the intellectual property of the Owner.

Code: The source code is not public.

The Application uses native Android libraries and open-source libraries, the rights to which are held by their respective authors.

9. User Data and Privacy

Data Collected: The Application collects email, password, and activation code.

Purpose: The data collected is used exclusively for the management of registration, login, and activation of the Application.

Error Management: The Firebase Crashlytics service is used for error management in the Application.

Communications: The Owner reserves the right to use the user\'s email for communications about the Application.

Sensitive Data: The Application does not store any type of sensitive information.

Third Party Services: The Firebase Crashlytics service is used.

Storage: Information is stored securely and is not shared with third parties unless required by law.

10. Liability and Warranties

Limited Warranty: The Owner will make every effort to ensure the proper functioning of the Application but cannot guarantee the complete absence of errors.

Usability: The Owner guarantees that the Application will operate within reasonable usability limits.

Limitation of Liability: The Owner is not responsible for: 

Errors or interruptions in the operation of the Application.

Loss of data or videos for any reason.

Misuse of the Application by the user.

Failures in the connection or transmission of data.

Errors caused by problems in the recording device or in the receiving device.

Any other consequences not directly attributable to the Owner.

Support: In case of finding a problem in the app, the user can contact the owner through the specified email.

Compensation: The user will not be entitled to any financial compensation if the app stops working for any reason.

11. Applicable Law and Conflict Resolution

Applicable Law: These Terms and Conditions are governed by Spanish law.

Direct Negotiation: In the event of a conflict, both parties agree to try to resolve the dispute in good faith through direct negotiation.

Mediation: If direct negotiation is not possible, both parties will try to reach an agreement through mediation.

Courts of Justice: If an agreement is not reached through direct negotiation and mediation, the parties expressly submit to the jurisdiction of the Courts and Tribunals of Santander, waiving any other jurisdiction that may apply to them.

12. Changes to the Terms and Conditions

Notification of Changes: If changes are made to these Terms and Conditions without an update to the Application, the Owner will notify the users of the changes by email.

Acceptance of New Terms: Continued use of the Application after notification of changes will be considered acceptance of the new Terms and Conditions. The email will ask for acceptance of the new terms.

Right to modify: The owner reserves the right to modify these terms and conditions at any time.

Initial Acceptance: The Terms and Conditions are accepted by means of a checkbox at the time of registration.

13. Miscellaneous

Integrity: If any of the clauses of these terms and conditions is void, the rest of the document will remain in force.

Language: The language of this document is Spanish. If there is a translation, the Spanish version will always prevail.

14. Entry into force

These Terms and Conditions will enter into force on 01/02/2025.
